We urgently call on the Spanish Ministry of Justice to grant a pardon for Jewel Lazaro, an American mother sentenced to 3 years and 3 months in prison for “child abduction”—for taking her own daughter to safety.
Jewel’s story is not one of a criminal, but of a mother fighting to protect her child. Despite documented domestic violence and multiple violations of custody agreements by the father, Jewel is the one being punished—while the man who took their daughter and ignored court orders faces no consequences.
To make matters worse, Jewel is now the sole caregiver to her 8-month-old baby, SG. Imprisoning her would mean forcibly separating a newborn from her mother.
This is a miscarriage of justice that must be stopped. Legal experts and human rights advocates warn that this case contravenes Spanish constitutional law, the European Convention on Human Rights (ECHR), and the UN Convention on the Rights of the Child. The denial of access to her eldest daughter, forced separation of a mother and baby, coupled with the denial of legal recourse, is a violation of fundamental rights and could set a dangerous precedent for victims of domestic violence seeking safety.
We demand clemency for Jewel and call on the Spanish government to act now.
Why This Matters:
•The Hague Convention had been mis-used to order the return of the child to Spain, despite serious child protection risks. Then Criminal charges were brought in Spain by the father despite US agreements that if the child was returned they would be protected.
• Jewel followed the law—but her ex repeatedly violated custody agreements without punishment.
• An 8-month-old baby will lose her mother if this sentence is carried out.
