The Los Angeles County Department of Beaches and Harbors released a statement on August 7th, 2025, claiming it did not authorize or participate in the Ralphs access closure. It states that the wall was built in July by Bay View Management without County notice. Additionally, it explains that public access remains via Thatcher Avenue, with efforts underway to establish a formal ADA-compliant entry at that access point. It also states that DBH and Supervisor Holly J. Mitchell’s Office are working to "address concerns at the Ralphs-adjacent location."

As this statement addresses concerns regarding park access through the private residence buildings lining the park, it declares: "Regatta Seaside, Azzurra, and Cove Homeowners Associations built gates, pathways, and drainage structures that encroached on Burke Park without permission. These structures, which are not ADA-compliant, damaged the park’s landscaping and created safety risks. The County first learned of these unauthorized private park entrances and requests for their removal were made in March 2024. The HOAs were instructed—and initially agreed—to remove the encroachments and restrict gate use to emergencies only."

IN RESPONSE TO THIS STATEMENT BY THE DEPARTMENT OF BEACHES & HARBORS OF LA COUNTY:

The homeowners of Azzurra, Regatta, and Cove were neither informed nor involved in the construction of the Ralphs wall, nor in any walkway non-compliance. Furthermore, the ingress and egress access from the lower levels of the residences has existed, been used, and maintained for nearly 20 years. Additionally, residents purchased their homes with the expectation of having direct access to and from the park via the buildings.

Foremost, the residents of Azzurra, Regatta, and Cove care about Marina del Rey and its entire community. They have never intended to create “private access solely for the residents,” contrary to claims by the Department of Beaches and Harbors.

Our goal and sincere request to community leaders is to restore and protect all access points to and from Yvonne B. Burke Park, ensuring the ongoing safety, well-being, and happiness of the entire community.
