PETITION: PRESERVATION OF THE R301 BAINSKLOOF PASS – A NATIONAL MONUMENT AND UNESCO WORLD HERITAGE SITE

To the Western Cape Government,

The undersigned, residents and concerned stakeholders, hereby petition the Western Cape Government to take immediate and effective action to preserve the R301 Bainskloof Pass. This iconic pass, completed in 1853, is a national monument situated within a UNESCO World Heritage Site of inestimable value.

Current Situation:

Despite its protected status and the substantial investment of over R500 million in its recent renovation, the R301 Bainskloof Pass is increasingly plagued by illegal activities and a lack of law enforcement.  Every weekend, this tranquil and scenic location is transformed into a site of rampant lawlessness, including:

    Illegal Parking: Vehicles are parked illegally along the provincial road, obstructing traffic flow, creating hazardous conditions, and hindering emergency vehicle access. This poses a significant risk to public safety.
    Public Intoxication and Littering: The consumption of alcohol in public areas and the subsequent littering, including broken glass bottles, creates an unsightly and unsafe environment, posing risks to wildlife and the natural environment.
    Uncontrolled Fires: The irresponsible lighting of fires has resulted in numerous devastating mountain fires, endangering lives, property, and the unique fynbos ecosystem, a critical component of the Cape Floral Region.
    Misuse of Designated Parking Areas: Parking areas intended for visitors and tourists are being misappropriated as drinking spots, denying users access and detracting from the intended recreational use of the pass.
    Damage to Road Infrastructure: Heavy-duty trucks, which are prohibited from using the pass, are causing significant damage to the recently renovated road surface, leading to increased maintenance costs and posing a danger to other road users.
    Illegal Dumping: The pass is being used as an illegal dumping ground, further polluting the environment and detracting from the aesthetic beauty of this protected area.

Demand:

The undersigned demand that the Western Cape Government take the following urgent actions:

    Declare the R301 a Toll Road: The implementation of a toll system is a proven method for regulating traffic flow, deterring illegal activities, and generating revenue for the ongoing maintenance and preservation of the pass. This will contribute to the long-term sustainability of the R301.
    Increase Law Enforcement Presence: A significantly increased and consistent presence of law enforcement officials is essential to deter illegal activities, enforce traffic regulations, and hold offenders accountable. This must include regular patrols, especially during weekends and public holidays.
    Implement Stringent Regulations and Monitoring: The Western Cape Government must implement and enforce stricter regulations regarding the use of the pass, including a complete ban on heavy-duty trucks, rigorous enforcement of parking restrictions, and increased monitoring of activities along the pass.
    Engage with Stakeholders: The Western Cape Government must actively engage with local communities, environmental organizations, and other stakeholders in the development and implementation of a comprehensive long-term management plan for the Bainskloof Pass. This plan should prioritize the preservation of the natural environment, the safety of road users, and the protection of the historical and cultural significance of the area.

PETISIE: BESKERMING VAN DIE R301 BAINSKLOOFPAS – 'N NATIONALE MONUMENT EN UNESCO-ERFENISGEBIED
Aan die Wes-Kaapse Regering,

Ondergetekendes, inwoners en belanghebbendes, doen hiermee 'n dringende beroep op die Wes-Kaapse Regering om onmiddellike en effektiewe stappe te neem om die R301 Bainskloofpas te beskerm. Hierdie ikoniese pas, voltooi in 1853, is 'n nasionale monument en geleë binne 'n UNESCO-wêrelderfenisgebied van onskatbare waarde.

Huidige Probleem
Ten spyte van sy status en die aansienlike belegging van meer as R500 miljoen in die opgradering daarvan, word die R301 Bainskloofpas toenemend geteister deur onwettige aktiwiteite en 'n gebrek aan wetstoepassing . Naweke word die pas omskep in 'n area van wetteloosheid, insluitend:

Onwettige parkering: Voertuie word op gevaarlike en ontoelaatbare plekke geparkeer, wat die vloei van verkeer belemmer en die veiligheid van padgebruikers in gevaar stel.
Openbare dronkenskap en rommelstrooiing: Die verkwisting van alkoholiese drank en die agterlating van rommel, insluitend glasbottels, skep 'n onveilige en onooglike omgewing, en stel 'n risiko vir wild en die omgewing in.
Veldbrande: Die onverantwoordelike aansteek van vure het reeds tot talle verwoestende veldbrande gelei, wat lewens, eiendom en die unieke flora en fauna van die gebied bedreig.

Skade aan die pad: Swartvragmotors, wat nie die pas behoort te gebruik nie, veroorsaak ernstige skade aan die pad, wat lei tot verhoogde onderhoudskoste en 'n gevaar vir ander padgebruikers inhou.
Onwettige afval/rommelstorting: Die pas word toenemend gebruik as 'n onwettige stortingsterrein, wat die omgewing verder besoedel en die natuurlike skoonheid van die gebied skaad.
Eis
Ons, die ondergetekendes, eis dat die Wes-Kaapse Regering dringend die volgende stappe doen:

Verklaring van die R301 as 'n tolpad: Die implementering van 'n tolpad is 'n bewese metode om verkeer te reguleer, onwettige aktiwiteite te verminder en fondse te genereer vir die instandhouding en bewaring van die pas.
Verhoogde wetstoepassing: 'n Verhoogde teenwoordigheid van wetstoepassingsbeamptes is noodsaaklik om onwettige aktiwiteite af te skrik en oortreders aanspreeklik te hou.
Strenger regulering en monitering: Die Wes-Kaapse Regering moet strenger regulasies implementeer en toesig hou oor die gebruik van die pas, insluitend die verbod op swaarvragmotors en die handhawing van parkeerbeperkings.
Gemeenskapsbetrokkenheid: Die Wes-Kaapse Regering moet die gemeenskap en ander belanghebbendes betrek by die ontwikkeling en implementering van 'n langtermynplan vir die bewaring van die R301 Bainskloofpas.
