The Issue

Hello friends, neighbors, and supporters of South Dakota’s small business community,

We need your help to update an outdated law that’s hurting our local economy and small business owners.

Right now, South Dakota’s cottage food law requires home bakers to be physically present every time their goods are sold. This means local gift shops and small stores cannot legally sell pre-packaged, shelf-stable baked goods on behalf of these bakers.

For many bakers — moms, families, side hustlers — baking is a vital source of income. For stores like ours, selling these goods has been a crucial part of keeping doors open and serving the community.

Other states have already updated their cottage food laws to allow retail stores to sell safe, low-risk baked goods made by licensed home bakers, with proper labeling and food safety standards in place.

We’re asking South Dakota lawmakers to do the same:

Allow retail sales of pre-packaged, non-potentially hazardous baked goods made by licensed home bakers
Maintain labeling and safety requirements to protect customers
Help small businesses and bakers thrive together in our community
Your signature will show lawmakers that South Dakotans support their local small businesses and want a law that reflects modern realities — where people shop, support local makers, and build community.
