This is not really our fight but We believe it is related. Jerry Berhorst and his wife owned the TAP restaurant in St Charles Mo He financed the purchase of the restaurant through Peoples Bank and Trust (" PBT Bank" in Troy. He made all the payments. Despite the Berhorst making all the payments they accelerated his mortgage and took his business which he had paid $500k towards and had appreciated substantially since he bought it at the height of the crash. Then PBT was the only bidder and bid below what the loan value was and then today took his home for what they called the deficiency despite there being more than enough equity in the property to cover the loan. It was subsequently discovered that PBT Bank was also the seller of the restaurant when Berhorst purchased the property through another bank called New Frontier Bank. PBT Bank owns or has a substantial equity position in New Frontier Bank. PBT did not disclose this to the Berhorst when they purchased the property. We believe that the Berhorst were victims of a loan to own program. Where the bank got the bad loan off their books as they were in trouble with regulators on the restaurant property. Then set the Berhorst up so they could get the property back at a future date when the market recovered by making it impossible for them to refinance.
Can you imagine having a successful business making all your payments and having the bank come in and take everything you worked 7 days a week for?
We have watched for years as PBT bank has been awarded the banking contract for Lincoln County without a competitive bid process required by law. We also discovered some serious issues with Leah Askey and her loans. In Leah's own words she has not made a payment since September on her nearly million dollar property on Highway 47. Which is also financed at PBT Bank. The Berhorst made all their loan payments and they took the property and his home. Leah still has her property and her Cadillac!
Lincoln County government officials have to institute some internal accounting controls including a bid process to make sure County money is safe and ethically managed and handled. As a citizen and taxpayer we should not be financing these kinds unethical situations. What happened to the Berhorst is unacceptable. We should all be appalled. We at Citizens to Stop Lincoln County Corruption encourage our members to let PBT bank know how you feel about the Berhorst forclosure and move your money to a reputable bank. Also let your County Commissioners and Lincoln County elected officials know this is unacceptable treatment of small business people. County Commissioners we are talking to you! We want you to change banks now! Can you hear us?
