Our sources formally confirmed today that Leah Askey Chaney and Joel Eisenstein are under investigation for fraud and embezzlement of the Durgin Trust. Leah Askey is the current prosecuting attorney of Lincoln County and Joel Eisenstein is the assistant prosecuting attorney for Lincoln County who is suspended from the practice of law indefinitely. Joel Eisenstein was appointed trustee for that late Mr. Durgin who had two children. Subsequently the heirs sued to have Mr. Eisenstein replaced. (Richard J. Durgin Trust v. Joel Eisenstein, Case number 1511-PR00251) The suit alleged that Mr. Eisenstein unethically used funds from the trust for personal use and withdrew excessive amounts of money. On July 1, 2016 Joel Eisenstein was removed as trustee from the Durgin Trust. Commerce Trust Company (CTC) was subsequently named as successor Trustee. CTC promptly retained a forensic accounting firm to investigate embezzlement and misuse of funds. ( suspension of Joel Eisenstein motion to dismiss readmission SC96011 - IN RE: JOEL B. EISENSTEIN, PETITIONER)   In subsequent litigation involving Leah Wommack Askey disturbing large money transfers were discovered into Novellus LLC (Leah Askey owns Novellus LLC ) from the Richard J Durgin Trust. Shortly thereafter Leah Askey transferred the money to her mortgage for her real estate at 854, 856 & 884 E Highway 47 in Troy Mo. Said mortgage was also at the People Bank and Trust PBT Bank in Troy Mo. The mortgage in question was in threat of foreclosure at the time. Our sources confirm that there are multiple concurrent investigations into Prosecutor Leah Askey and Assistant Prosecutor Joel Eisenstein for misuse of public funds from Lincoln County in the form of paychecks to Joel Eisenstein from the county when he was suspended from the practice of law and could not work as a prosecutor. As well as the charitable and trust funds outlined above. On March 8, 2017 Office of the Chief Disciplinary Counsel of the Missouri Bar accepted jurisdiction over the complaints of the parties and launched a formal investigation into misuse, fraud & embezzlement of the Durgin Trust monies as well as misuse of funds from the Rise Above Scholarship Foundation by Leah Askey. The alleged fraud was also done at the Peoples Bank and Trust (PBT Bank). (Office of Chief Disciplinary Counsel File for Leah Askey File #17-292 and File for Joel Eisenstein #17-293) It is unclear if Peoples Bank and Trust President Donald Thompson or bank authorities were aware that these transfers of money were taking place from the county, charity or the trust. It would behoove the bank to launch an immediate investigation and freeze all accounts of the parties until ownership of the money could be lawfully determined. What we do know is cancelled checks do not lie. In sum, Prosecutor Leah Wommack Askey and Assistant Prosecutor Joel Eisenstein must resign from the Prosecuting attorney’s office immediately. Joel Eisenstein does not have a license to practice law. Leah Askey is under investigation for very serious charges and bringing suits on the County for her continued wrongful actions like prosecuting innocent people and misusing Sheriffs Department equipment to surveil her opposing parties and attorneys. Leah Askey is unable to fulfill her duties as a prosecuting attorney while under investigation for such serious charges. Any cases she has filed or will file will have to be reviewed by a third party independent prosecuting attorney and independent judge. Finally, we were informed that Sheriff Cottle received an award from some group in Virginia. Bet the Virginia Group did not know he was being sued for Civil Federal Wiretapping violations and if proven Cotttle and anyone involved with the activity could be charged with a federal crime as a governmental official for illegal wiretap. (United States District Court in the Eastern District of Missouri Case Number 4:17CV772DDN. suit was filed on February 21, 2017 Note this is not in the Missouri State Court system It is in the United States District Court Eastern District Which does not have a public viewing case search You can call the court clerk and get verification and information at 314 539-2212 The Clerks are very nice and are happy to help you get the information you need) If convicted Sheriff Cottle will be ineligible to continue as Sheriff. Instead of doing some re-assessments and removals for wrong doing over the past few years the county continues with the path of denial. We believe they will continue with that narrative till the cash runs out from all the lawsuits that are filed on a weekly basis. A special note to Joel Eisenstein and readers: All information obtained in this update was done so via public records on casenet below is a excerpt from those records: These improper actions on the part of the Respondent have caused Petitioner to closely examine Respondent’s work history and standing in the legal community and such inquiry has resulted in grave findings. St Charles Circuit Div - April 21, 2016 - 17. Petitioner has learned that Respondent has previously pleaded guilty to a federal misdemeanor for wilfully failing to file an income tax return. 18. On April 5, 2016, the Missouri Supreme Court handed down its opinion and decision in In Re Joel B. Eisenstein, No. SC95331, wherein it found Respondent guilty of a number of violations of the Rules of Professional Responsibility governing the legal profession (see Exhibit “3” attached). 19. In its decision, the Court noted that Respondent has been disciplined on five prior occasions. He has twice been admonished for ethical violations relating to dealings with a court, and in 1997 he was suspended by the Missouri Supreme Court after he pleaded guilty to the aforesaid federal misdemeanor charges for willfully failing to file an income tax return. In 2001, Respondent was admonished for failing to respond to the Office of Chief Disciplinary Council with regard to a pending ethics complaint. And, finally, in 2004, Respondent was admonished for violating Rule 4-3.3(d) for failing to inform the Court of material facts relevant to a pending issue. 20. In the disciplinary matter recently before the Missouri Supreme Court, Respondent reviewed and utilized illegally-obtained documentation during a divorce case and then was found to have actually threatened opposing counsel after his conduct was revealed. According to the opinion, Respondent made the following statement to the opposing attorney: “I’m not someone you really want to make a lifelong enemy of, even though you are off to a pretty good start.” Although Respondent attempted to explain his conduct, the Missouri Supreme Court specifically held that it did not find his explanation to be credible Tisk Tisk one should learn the lessons of prior punishments Joel!
