Preventing The President from a Self Pardon

The Issue

There has been much discussion about whether a sitting president may or may not issue a pardon for themselves.  For a president to do such a thing would be a gross abuse of power and would set the president above the law.  In the case that he or she breaks the law, he or she should be subject to the same law as the rest of the country.

Therefore, I propose that Article II Section 2 of the Constitution be amended to say "the president may not issue a pardon for any crimes the president has committed."  Elsewhere in the Constitution it should be stated that "The Supreme Court may grant a pardon to the president if legal merit is found for such a course of action."

These amendments would prevent two things from happening.  One, it would prevent a misapplication of the presidential pardon to a cause that affects the president, essentially preventing the president from escaping the reach of the law, and balancing the power of the presidential pardon.  Two, it prevents the president  from not having a court of last resort in the case of the president being unjustly indicted.  This allows for another check and balance in our ever evolving democracy.
