"Qu'est-ce que le ''Droit Humain à l'Environnement Sain"

Tout le monde a le droit à un environnement sain.Un environnement sain est considéré comme une condition préalable à la réalisation d'autres droits humains, dont le droit à la vie, à l'alimentation, à la santé et à un niveau de vie suffisant. Cet aspect est mentionné en partie dans l'énoncé  au droit à la santé apparaissant dans le Pacte international relatif aux droits économiques, sociaux et culturels PIDESC (https://www.wipo.int/edocs/trtdocs/fr/un-icesc/trt_un_icesc.pdf), qui signale que tous les États doivent assurer la réalisation du droit à la santé en assurant, entre autres, l’amélioration de tous les aspects de l’hygiène du milieu vital. Il a également été reconnu dans divers instruments relatifs aux droits humains, tels que:
Le Protocole de San Salvador (https://www.cidh.oas.org/Basicos/French/e.sansalvador.htm) ainsi que par l'instauration en 2012 du mandat des Procédures spéciales des Nations Unies concernant les droits humains et l'environnement (https://www.ohchr.org/FR/Issues/Environment/SREnvironment/Pages/SRenvironmentIndex.aspx).

Chacun et chacune devrait pouvoir vivre dans un environnement favorable à sa santé et à son bien-être. Les États devraient prendre des mesures concrètes et progressives, individuellement et en coopération les uns avec les autres, pour élaborer, mettre en œuvre et maintenir des cadres appropriés pour réunir tous les éléments nécessaires à un environnement sain et durable, qui englobe l'ensemble du monde naturel.  Ils devraient, notamment, assurer le contrôle des entreprises et autres acteurs privés dans leurs activités dans le pays et à l'extérieur.
Selon les principes établis du droit international, dont les dispositions du PIDESC, la coopération internationale pour le développement et la réalisation des droits humains est une obligation qui incombe à tous les États. Une telle collaboration et un tel soutien, surtout de la part des États qui sont en mesure d'aider les autres, sont particulièrement importants pour faire face aux impacts transnationaux sur les conditions environnementales, comme les changements climatiques.

Pourquoi la clause est indispensable et indissociable de la Charte des droits élémentaires de l'Humain
1-Considérant que "L'humain a un droit fondamental à la liberté, à l'égalité et à des conditions de vie satisfaisantes, dans un environnement dont la qualité lui permette de vivre dans la dignité et le bien-être. Il a aussi le devoir solennel de protéger et d'améliorer l'environnement pour les générations présentes et futures", il est absolument indispensable d'ajouter cette clause à l'article 3 de la Déclaration Universelle des Droits de l'Humain...
2- Considérant que cette clause devait y figurer depuis que l'environnement planétaire se dégrade exponentiellement et qu'il est urgent d'impliquer les états d'une façon législative et juridique non-discutable et non-négociable à la préservation de la planète...
3- Considérant que la justice internationale à un besoin extrêmement urgent d'un "outil" et d'un cadre juridique mis à sa disposition pour pouvoir agir en cas de non-respect de ce droit fondamental...
En tenant compte de ces 3 points élémentaires et du fait que la planète subit des bouleversement considérables depuis 1948(*) nous, Earthforce Fight Squad, une ONG citoyenne de Sauvegarde de l'Environnement et du Vivant, proposons que le ''Le Droit de l'Humain à l'Environnement Sain'' soit ajouté à l'article 3 de la ''Déclaration Universelle des Droits de l'Humain'' d'une façon urgente et définitive !

What is the "Human Right to a Healthy Environment"

Everyone have a right to a healthy environment. A healthy environment is considered as a prerequisite for a realisation of other human rights like the right to life, food, an adequate and decent standard of living. This aspect is partly mentioned in the statement on the right to health as it appears in the International covenant on economic, social and cultural rights  ICESCR (https://www.ohchr.org/Documents/ProfessionalInterest/cescr.pdf) which provides that all States must secure the realisation of the right to health by ensuring the improvement of all of the aspects of environmental health. It has also been recognized in various human rights instruments such as the San Salvador Protocol (http://www.oas.org/juridico/english/treaties/a-52.html)  and the introduction in 2012 of the Mandate of the United Nations special procedures regarding human and environmental rights (https://www.ohchr.org/EN/Issues/Environment/SREnvironment/Pages/SRenvironmentIndex.aspx). The Stockholm Declaration of june 1979 (http://www.un-documents.net/unchedec.htm) the 1989 Convention (n°169) concerning Indigenous and Tribal Peoples (https://www.ilo.org/dyn/normlex/en/f?p=NORMLEXPUB:12100:0::NO::P12100_ILO_CODE:C169) and more recently in France The Biodiversity Law (https://www.gouvernement.fr/en/a-biodiversity-agency-for-a-new-relationship-between-humankind-and-nature). Each and everyone should bee allowed to live in an environment beneficial to its health and well being. The States should take concrete and progressive measures, individually and together, to develop implement and maintain a structured and appropriate approach to meet all the requirements for a healthy and sustainable environment which incorporates the whole natural world. They should amongst others, ensure the compliance with such standards of companies and others private sector actors, in their activities within or outside the country. According to the well established principles of international law, like the ICESCR provisions, the international cooperation for the development and realisation of human rights is the obligation of All States. Such a cooperation and support, especially from the States that can help some other ones are particularly important to face the transnational implications on environmental impact such as climate change.

Why the clause is indispensable & inseparable from the elementary Human rights chart (**)

1- Given that "Human has a fundamental right to freedom, equality and decent living conditions in an environment whose quality allows living in dignity and well being. He also has the solemn duty to protect and improve the environment for the present and future generations", it is absolutely essential to add this clause to the article 3 of the Universal Declaration of Human Rights...

2- Given that this clause was to be included since the global environment has deteriorated exponentially and it is urgent to involve the States in a legislative and legal way that is unquestionable and non negotiable to preserve the Planet...

3- Given that international justice has an extremely urgent need for a tool and a legal framework available to act in the event of failure to respect this fundamental right...  

Taking into account these 3 elementary points and the fact that the planet is experiencing considerable upheaval since 1948, we, Earthforce Fight Squad a citizen's NGO for the conservation of the environment and life, propose that the "Human Right to a Healthy  Environment" be added to Article 3 of the Universal Declaration of Human Rights" in an urgent and definitive manner !
