The states much slower reply was a desperate attempt to salvage their dwindling hopes of a dismissal and was filed on September 10. The state simply highlighted to the court that their was still a deficiency in the complaint that needed resolved while challenging the validity of claims I had made in my response, specifically proof I was dually enrolled in the Cherokee Nation and United Keetoowah Band as well as proof of unjust civil actions adjudicated against myself by the state.           If the first response had set any world records for its speed, this response broke them when it was on record with supporting documentation nearly an hour faster than the first. This response addressed and corrected all the concerns of the deficiency, which I had simply failed to list 25 USC §180 on the complaint, which was necessary to establish the initial theft of the Cherokee tribal lands. However §180 was violated more than a century ago, a fact I felt the statute of limitations made listing it on the complaint improper.

          The response not only exposed obligations the court had been ignoring for months with Reynoldson v Shillinger (1990), a directive from the 10th circuit that the courts are to affirmatively assist pro se litigants in resolving deficiencies, it also cited two civil actions adjudicated against myself in which basic Constitutional rights had been violated by a potentially corrupt judiciary.
