Un utilizzo mascherato da tutela: L’equino viene spesso descritto come animale domestico,
riconosciuto come essere senziente dall’articolo 13 del TFUE,
e celebrato come atleta quando partecipa a competizioni.
Queste tre definizioni convivono.
Ma nella pratica producono una contraddizione strutturale.
Nella vita quotidiana, l’equino non è mai trattato come un animale da compagnia come cane o gatto.
La sua detenzione richiede codice stalla, registrazioni sanitarie, obblighi assicurativi.
Ogni spostamento va comunicato all’ASL.
Per condurlo su strada pubblica serve una patente, con costi e requisiti specifici.
Durante la carriera sportiva o lavorativa, l’equino è regolato, tracciato e inserito in un sistema che produce valore economico,
anche per lo Stato, attraverso scommesse, premi, lavoro e gettito fiscale.
In questa fase, la tutela esiste.
Ma è una tutela funzionale all’utilizzo.
Quando la carriera termina, la protezione si interrompe.
La tracciabilità si indebolisce.
La responsabilità pubblica scompare.
Il destino dell’equino diventa un fatto privato, emergenziale o affidato alla beneficenza.
Qui emerge il punto critico:
il riconoscimento dell’equino come soggetto senziente resta formale,
mentre la tutela concreta è parziale e condizionata alla produttività.
A differenza di cani e gatti:
non producono valore economico per lo Stato
non alimentano filiere pubbliche
non sono inseriti in un sistema produttivo
e non vengono “scaricati” da un sistema quando smettono di essere utili
L’equino, invece, è tutelato finché produce
e abbandonato quando smette di produrre.
Il Fondo Post-Carriera nasce per rendere visibile questa contraddizione
e per trasformare una tutela apparente in una responsabilità continua,
coerente con l’uso reale che viene fatto di un essere riconosciuto come senziente.
Non si tratta di cambiare definizioni.
Si tratta di non mascherare un utilizzo con una tutela incompleta.

A use disguised as protection
The equine is often described as a domestic animal,
recognised as a sentient being under Article 13 of the TFEU,
and celebrated as an athlete when participating in competitions.
These three definitions coexist.
But in practice, they generate a structural contradiction.
In everyday life, the equine is never treated as a companion animal like a dog or a cat.
Keeping an equine requires stable registration, health records and insurance obligations.
Every movement must be reported to the local health authority.
Leading an equine on public roads requires a specific licence, with costs and formal requirements.
During its sporting or working career, the equine is regulated, tracked and embedded in a system that generates economic value,
including for the State, through betting, prizes, employment and public revenue.
At this stage, protection exists.
But it is a protection functional to use.
When the career ends, protection stops.
Traceability weakens.
Public responsibility disappears.
The equine’s fate becomes a private matter, an emergency, or is delegated to charity.
Here the critical point emerges:
the recognition of the equine as a sentient subject remains formal,
while concrete protection is partial and conditional on productivity.
Unlike dogs and cats:
they do not generate economic value for the State
they do not feed public production chains
they are not embedded in a productive system
and they are not discarded by a system once they stop being useful
The equine, instead, is protected as long as it produces
and abandoned when it no longer does.
The Post-Career Fund exists to make this contradiction visible
and to turn apparent protection into continuous responsibility,
consistent with the real use made of a being recognised as sentient.
This is not about changing definitions.
It is about not disguising use with incomplete protection.
