OBJECT: DEMAND OF DELIVERY 30 day notice

 


Dear Santa Monica California Legal Department for UMG:

I, the undersigned has made full payment to you in the sum of [AMOUNT] for merchandise to be shipped by you pursuant to my accepted order dated (date and include order number  in the amount of (and amount you paid). I demand delivery of said goods in accordance with my order (insert order number), since said goods have not been received by me at (include your address you shipped items to) as per terms of my order (insert order number again and include the ship by date promised). 

It has been (enter length of time in days) since the ship by date. (Enter dates and email communication with UMG in regards to your order), are the dates I contacted (enter email address you sent a request for an update on your order, even multiple if you have) I have tried to contact, only to have BOTS respond with a generic response to my requests for updates and it’s been (enter number of days) with no communication (or if the bot responded list that date and the date and time you replied back to them) as well as no follow up since said correspondence with UMG customer service.

Unless said goods are received by me on or before [30 days from letter and enter your address) I shall consider you to be in breach of contract and I shall there upon expect a full refund and filing a complaint with the FTC and as well as (Your State and Name of your Attorney General), reserving such further rights as the consumer who is protected by FTC Laws for Telephone, Mail Order or Online Order

Rule Summary

The Rule, issued in 1975, requires sellers who solicit buyers to order merchandise through the mail, via the Internet, or by phone to have a reasonable basis to expect that the sellers can ship within the advertised time frame, or, if no time frame is specified, within 30 days. The Rule also requires that, when a seller cannot ship within the promised time, the seller must obtain the buyer’s consent to a delay in shipping or refund payment for the unshipped merchandise and for any other damages sustained.

It has also been passed around the online fandom/music community that UMG blacklists people that hold Universal Music Group responsible for damaged items, chargebacks after 30 days and for filing complaints. The FTC also has rules and regulations in regard to this practice we sincerely hope isn’t true. 

I, (enter your name) demand to hear your intentions in regard to shipping my order, refunding my order as well as your intentions blacklisting consumers like me, which is against the law under FTC laws.

As you know, the FTC enforces federal consumer protection laws that prevent fraud, deception and unfair business practices which is believed to be the issue here at hand.. The Commission also enforces federal antitrust laws that prohibit anticompetitive mergers and other business practices that could lead to higher prices, fewer choices, or less innovation.

The FTC administers a wide variety of laws to protect consumers against companies with unfair business practices. In total, the Commission has enforcement or administrative responsibilities under more than 70 laws.)

After you read this, delete this section. 

(Do NOT give them your phone number unless they agree for the phone call to be record recorded). 

Inform them that the call will be recorded and if they agree to the recording of your conversation. Ask clearly and intentionally one more time, if they accept being recorded a second time with them giving you a clear answer to communication on record via a recorded line. Make sure this is all in email. 

(If they refuse, make sure you confirm they refuse to be recorded and they can mail/or email you their response, reminding them you’ll pursue a resolution through governing agencies or a very looming class action lawsuit)
