We need national standards. Despite consistent warnings through the last 100 years, the claim that business will leave or not locate in a state due to workers’ compensation costs is persistent and has overtaken the dialogue, justifying cutbacks for workers’ benefits allegedly to foster business development or retention. The National Commission rejected this theory, it has been debunked repeatedly, and yet it reemerges like a phoenix. There does not seem to be
any way to address this persistent claim without establishing national standards for these state programs. The logistics of doing this would certainly be complex, but it may be essential. Some of the 1972 Report can still provide guidance for appropriate standards, but new benefit adequacy issues are raised by the more recent changes in state laws, and these would need to be addressed as well.
