Please pass a legislation giving healthcare providers court protection for their lifetime investment of time and money to care for others when in need.
The Issue
Proposed Legislation to allocate A Court Of Jurisdiction for civil complaints arising under "The Medicare Act".
This legislation would in no way have an effect on or offer adjudication of claims for any Medicare beneficiaries outside of the CMS ALJ's jurisdictional venue.
Without this legislation, after enough creditors continue to lose money by default from providers suffering financially from these kinds of activities, the entire health care industry would become much too significant a risk for any investor, thereby, reducing the availability of care to the general population. Something this country cannot afford to allow to happen!
In no way is this Legislation an attempt to mitigate the government's effort to curb Fraud & Abuse for the pilferers and liars who take advantage of the system. It would simply aid to strengthen those efforts by placing contractors on notice that they need to make sure the performance of their contractual obligations is done correctly or they will be subject to serious consequences. Government Contractors assigned to these tasks have a "Boiler Plate" plan to follow and there should be no reason for them not to follow it appropriately. Nor should anyone expect his or her performance to be anything less than accurate and correct at all times! After all, they expect it of each and every healthcare provider.
Neither Congress nor CMS should object to providing any assurances to these Providers that care for our most valued senior or disabled citizens. The Contractors that CMS has assigned the duties of "Gate Keeper" to watch over the Medicare Trust Fund will do so appropriately and not recklessly by jeopardizing any provision of care!
This Legislation does not avail a "Court of Jurisdiction" to frivolous complaints. Instead, it is intended to provide assurances to the much-needed financial investment arm of the industry that their investments will be protected from any inappropriate activities deemed committed by these assigned government contractors. These investors and their investments are the strength of the industry!
Currently, all of the careless, incorrect, duplicate, inappropriate, and reckless actions by CMS Contractors continue to plague and gridlock the health care system with no admission of error on their part at all. These actions seem to continually increase and go unabated resulting from a "Lack of Jurisdiction" as cases are decided on by various levels of both the ALJ's as well as the Federal Court System.
Congress has a dual Fiduciary responsibility regarding health care. First, ensure that the citizens of our country have access to reputable, quality healthcare providers and second, protect the entrusted funds needed to pay for any services required to keep those citizens healthy. Government Contractors that are not performing their responsibilities properly and accurately are jeopardizing all citizens and healthcare providers. They are putting such a financial strain on these healthcare providers that it is causing them to go out of business in most cases, which leaves the patient suffering and unable to survive without proper treatment or services.
The investment of time and money by devoted individuals in the health care field needs your attention NOW! They need protection to guarantee that their sacrifices are not being taken for granted by the careless and reckless actions of these Contractors that have been hand chosen by CMS to protect the one true thing that we, the honest, hardworking, healthcare providers are all in this for. The all-important "Patient".
