Dear James Farley, CEO, Ford, Kerry Kolodziej, Assistant Chief Counsel for Litigation and Enforcement, NHTSA, and Marty Makary, FDA Commissioner,
On August 11, 2025, Ford announced plans to build a new factory and electric truck. (https://www.npr.org/2025/08/11/nx-s1-5496651/ford-cheap-electric-truck
Because this is a new endeavor for Ford, there are no issues with having to recall existing vehicles for defective LED headlamp technology. In this situation, Ford is designing a new vehicle from scratch. If Ford plans on using LED headlamp technology, Ford must first petition NHTSA and the FDA for permission to sell these new trucks with LED headlamp technology so that NHTSA and the FDA may establish the required performance standards, including limits on luminance, spectral power distribution, and pulse width modulation, to ensure public health, safety, and civil rights.
NHTSA and the FDA are required to comply with 21 U.S.C. 360ii to publish the performance standards for LED headlamps. Current FMVSS-108 standards are inadequate for LED headlamp technology because FMVSS-108 lacks limits on luminance, spectral power distribution, and pulse width modulation.
I have copied in this email staff for members of Congress who are pushing NHTSA on this issue.
I request a response. Should Ford, NHTSA, and the FDA conspire to ignore this notice and not respond, it is my intent to file a federal lawsuit to compel Ford, NHTSA, and the FDA to comply with federal law.
