On May 29, 2023, the Soft Lights Foundation submitted a regulatory petition to the National Highway Traffic Safety Administration to comply with 21 CFR 360ii to publish performance standards for LED headlights. https://www.softlights.org/wp-content/uploads/2023/05/NHTSA-Petition-to-Collaborate-with-FDA.pdf
This new petition is the connector between our petition FDA-2022-P-1151 to the Food and Drug Administration to regulate all LED products, and the specific requirement for NHTSA to regulate LED headlights, LED tail lights, LED displays, etc. in vehicles. 21 CFR 360ii explicitly directs the FDA to liaison with other federal agencies to publish performance standards for electromagnetic radiation from electronic products, which includes the visible radiation emitted by LEDs. Both the FDA and NHTSA have failed to comply with this statute, and our petition notifies both agencies that they have a responsibility to comply with the Congressional mandate to protect public health and safety.
