At this time, we have accumulated the contact information for the main federal agencies responsible for protecting us from LED headlights, LED streetlights, LED household lights, and LED strobe lights. Today I attended a webinar with the Department of Energy, which showed me that the US government is still ignoring the health effects of LED light and ignoring us as citizens. Below is the letter I sent today to these key federal agencies.

Today I joined a webinar hosted by the US Department of Energy to discuss a proposed rule for luminous efficacy requirements of General Service Lamps. What was missing from the meeting was a discussion of the toxicity of LED visible radiation, how LED products are unsafe, and the lack of FDA regulation of LED products, including lack of restrictions for peak luminance, spectral power distribution, square wave flicker, and inverse square law dispersion.
The Soft Lights Foundation has been notifying your agencies for the past several years about the serious adverse health impacts from flat surface, directed energy LED visible radiation. We have petitioned the FDA to comply with the 1968 Radiation Control for Health and Safety Act and publish comfort, health, and safety regulations for LED products. We have petitioned NHTSA to require the automakers to petition the FDA and NHTSA for approval to use LED headlights and require that vehicle headlights emit light that disperses following an inverse square law. We have petitioned the FHWA to prohibit the use of extraordinarily dangerous LED strobe lights. We have petitioned the FDA to ensure that energy efficiency requirements include metrics for quality, including peak luminance, spectral power distribution, and square wave flicker. We have submitted requests to the House Oversight Committee to investigate the lack of regulation of LED visible radiation.
At this point in time, all of your agencies are aware that LEDs are not energy efficient compared to incandescent products, and that LED products are causing seizures, migraines, anxiety, massive light pollution, loss of visual freedom, and many other extremely serious harmful effects on humans and the environment.
Any continued act of ignoring these facts by your agencies constitutes negligence. As lawyers, you are well aware of the consequences of acting negligently. There are federal laws that protect citizens from acts of negligence or discrimination such as the Americans with Disabilities Act, Rehabilitation Act, and Federal Tort Claims Act. There are already numerous investigations by Human Rights Departments, multiple lawsuits involving discrimination and nuisance due to LED light, and likely upcoming lawsuits for defective products and violations of federal safety regulations for products, including vehicles, that use LED lights. The Soft Lights Foundation is expecting at this time that your federal agencies will act lawfully and with the duty of care required of you and your agencies to protect the public and and to publish rules that ensure that the visible radiation from LED products does not prevent equal access, does not harm humans or the environment, and does not violate the civil rights of citizens.
