After consultations with legal folk and numerous discussions around the current laws of Scotland, we have decided that an update should be proposed as part of the petition, as follows:
- The seller must provide a “survey” for the property being sold, which should be no greater than 90 days old at time of offer being made by a buyer. Once an offer is made & accepted, the buyer legally accepts the results of the survey as part of the purchasing process.
There are 2 key reasons for this proposal:
1. Far too often houses are sold in a state of disrepair that the buyer only becomes aware of, once the survey is paid for. If the information is provided up-front it may indeed save a lot of time and effort for both parties, given that the buyer will be fully aware of any work needed before making an offer.
2. The Survey is one of the most time consuming parts of the process, but having this up-front, a great deal of time will be saved, allowing completion to occur much faster than it does presently.
