Change their terms and how they handle copyright infringement!
The Issue
People who've had their blogs for years just lost all of their hard work unfairly. The way Yahoo/DMCA/Tumblr choose to handle copyright infringement is terrible. Tumblr's terms state that they have the right to terminate anybody's blog with no reason or notification. That is completely unfair and obnoxious. Their terms also say that if you receive 3 strikes in 18 months, your blog will be terminated. I also find that unfair because people have hundreds to thousands of songs on their blogs.
The DMCA has used a bot to go through Tumblr to find any and all copyrighted content. I completely understand the use of the bot. Tumblr only has 304 employees for millions of blogs & billions of posts. However the bot has even flagged and terminated people for lyrics! Theres really no human review of the content. The bot finds the content and immediately removes it.
After 5 years of blogging, my blog was terminated on February 10, 2015. A lot of people think "its just a website", but for me and many others, it's not just that. I read the email and tried to view the content but obviously I couldn't because my blog was no longer accessible. Realizing that this was only my 2nd strike I immediately emailed Tumblr support. Support only sent me a few confirmation emails and thats it. I also submitted a counter DMCA notice for in my termination email.
Six days later, Tumblr emailed me back with 8 different emails with different pieces of copyrighted content. I was beyond mad but what made me angrier was the fact that my DMCA counters for all the content was said to be "facially invalid" because the content doesn't exist anymore. That was completely unfair. I saw another person complete a successful counter but still Tumblr wouldn't restore the content or his blog. Even though he was right in everything.
So I'm asking Tumblr please reinstate blogs that were wrongfully terminated and change the way the handle these situations. My suggestion is: Tumblr should email users the links to any copyrighted material you find and ask that they remove it. Give us an ultimatum. Either remove the content ourselves in x amount of time or face the consequences (a strike or whatever kind of punishment you choose to implement). Believe me, if this had been done to me, all the music would've been deleted along time ago. I probably wouldnt even post anything I'd be so scared to lose my blog.
If you feel like Tumblr should reinstate blogs and change the way they deal with copyrighted material, please sign this! Hopefully we can get Marissa Mayer to see this.
Thank you!
