November 9, 2025 -- SBTC Executive Director James Lamb returns to INSIDE TRUCKING with BREAKING NEWS on FREIGHT BROKER TRANSPARENCY! On Friday, November 7, 2025, Pink Cheetah Express LLC ("Cheetah") filed a dispositive "Motion for Summary Reversal" with the US Court of Appeals in the Federal Pink Cheetah v. TQL lawsuit.
In the motion, Cheetah argues the District Court erred and that the November 30, 2023 communication from FMCSA to TQL directing removal of their contractual waiver of carriers' 371.3 transparency rights and instructing TQL to comply with 371.3 in terms of records requests from any and all carriers in the future, is an "order" under the definition in the Administrative Procedure Act. Cheetah offers a DC Circuit Appellate decision and a ruling from the U.S. Supreme Court to make the case that the November 30, 2023 notice was also "final agency action" on the complaint to Secretary Pete according to case law.
