The Issue

Douglas County voters deserve to understand how the rules governing their elected offices were established, how those rules changed, and how those changes affect their choices today.

My name is Amy McCoy. I sought to serve as a write-in candidate for Douglas County Commissioner, District 4. On September 24, 2026, the Board of Elections and Registration disqualified my candidacy under a 12-month district residency requirement added through a 2009 local law, Act No. 213.

I currently reside in District 4. I have filed for judicial review and requested emergency relief to challenge that decision.

The history behind this requirement matters. My understanding is that an earlier version of the law governing our county commission went before Douglas County voters. In 2009, four legislators sponsored an amendment adding the district residency requirement, without another vote by county residents.

That legislative change affects the choices available to an entire community. Today, Douglas County has grown to nearly 160,000 residents. People deserve to know what voters originally approved, what lawmakers later changed, and the legal basis for applying that change to candidates.

I am seeking the records needed to document that history and obtain a fair review of how the amended requirement applies to my write-in candidacy.

I know this is an uphill fight. I cannot promise the outcome, but I can demonstrate my commitment through my actions.

If I am asking residents to trust me to advocate for our community, I must be willing to advocate for myself—to ask difficult questions, seek the records, follow the legal process, and remain persistent when the path becomes difficult. That is the same determination I would bring to addressing housing needs, protecting neighborhoods, supporting responsible growth, and demanding accountable government.

Following my open records request, I received the hearing recording and some documents. I appreciate those materials being provided. However, other requested materials remain outstanding, including the exhibits referenced in the challenge.

We respectfully request that the Douglas County Board of Elections and Registration:

Complete its response to my records request, including any exhibits received or relied upon, and identify requested records that are not in its custody.
Provide the written decision and clearly explain the legal basis for applying the local district residency requirement to my write-in candidacy.
Provide available records documenting the earlier referendum, the 2009 amendment, public notice, and any federal voting-rights submission or determination—or identify the appropriate custodian.
Explain and apply eligibility standards consistently to similarly situated candidates.
Cooperate promptly with judicial review and comply with any resulting court orders.
You do not have to support my campaign to support transparency, voter voice, and fair treatment. Your signature supports these requests; it does not decide the legal case or constitute a campaign endorsement.

Please sign and share to support a complete public record, clear answers, and fair review.

Amy McCoy

I am currently challenging the disqualification through judicial review, with the outcome pending.
