On Friday, July 10th the following documents were filed in Union County Superior Court by Providence VFD. These are in addition to the Breach of Contract lawsuit already filed.
1. Amended Summons
2. Amended Verified Complaint (with exhibits)
3. Notice of Hearing for TRO and Preliminary Injunction
4. Lis Pendens.
In addition, Subpoenas, and Notices of Depositions for certain individuals have been prepared.
To view documents, go to the link included with this update or www.providenceVFD.com. In the Complaint you will find that Providence VFD is claiming fraud and is seeking a return of ownership of the land and building on Hemby Road in addition to triple damages and all legal fees. We hope to prove that the Town entered into the sale and following 10 year lease agreement WITH THE INTENT to undermine Providence VFD's ability to serve Weddington, and to bring in Wesley Chapel VFD to serve the Town. By these actions we are prepared to go to court and through a trial by jury present evidence which brings out (in public) a story of intimidation, manipulation, and collusion in order to facilitate the transfer of fire service to Wesley Chapel VFD by certain members of Council.
On Monday evening, July 13th at 7PM the Town of Weddington will hold another council meeting. One of the items on the agenda is to discuss and consider the sale/lease of the Hemby Road station to WCVFD. We believe Council is open to lease with the option to sell to WCVFD the land and building for the purchase price of $750K. Oddly, this is the exact amount of the penalty which the Town will need to pay for Breach of Contract to Providence VFD. In essence, the Town is willing to GIVE the Hemby station to WCVFD in exchange for WCVFD compensating the Town for the penalty to break the contract WITHOUT CAUSE.
The court will hear the case and determine temporary injunction on July 27th. July 29th is the date which Council has determined to be the last date of service for PVFD.
Providence VFD still holds as ITS NUMBER ONE PRIORITY...safety to the residents of Weddington. We will continue to provide the highest level of response to the residents for as long as we can. Your support is critical over the next few weeks. Our members are under added stress, not knowing whether their jobs will continue past July 29th.
Also...filing for the November elections has begun. Mayor Deter has filed for reelection, along with several candidates in SUPPORT of Providence VFD - Janice Propst, and Mikki Weaver. Pam Hadley has not filed to as of this posting.
