Please send the message to our Senators and Representatives to stop absolute and qualified immunity and enact civil penalties to attorneys who intentionally deceive judges to win. It’s time to end the lawyer’s immunity now!

This bill will correct the problem in Massachusetts because Absolute Immunity given to attorneys, has created two (2) classes of citizens, one privileged (the attorneys), and the other class, the rest of us, not privileged, leaving the non-privileged without a remedy in the court system.

There is no logical reason to allow lawyers to be deceitful in a court and then give the deceitful lawyer the "award" of immunity.

We the people of Massachusetts deserve the protection in the judicial system!

Our hope is that this legislation will help Massachusetts residents to NOT go through the many years of torment that we have gone through in our quest for justice.

We want you to know that we have great respect for the many honest attorneys who take their oath as Officers of the Court seriously! We hope that "honest" attorneys will also sign this petition.

We need to stop attorney immunity because what happened to us, and has happened to so many people, could certainly happen to you!

We have lost so very much - our home, restaurant, livelihood, reputation and so much more because the Town, with the aid of their attorneys, lied to the courts to win.

THE REAL WORLD:

It was so simple – the Town's attorneys lied, they won, they claimed immunity, they were protected!

The fact is, this is how it works in the "real world", the deceitful attorneys know that they "can get away with" lying and concealing documents from the judge(s) and then ask the judge for immunity and it is granted.  

We filed our Senate Bill No S.1017 because judges should NOT give immunity to any attorney who is involved in deceit, fraud, cover-up, extortion, conspiracy, abuse of process and obstruction of justice.

It is time for Massachusetts residents to have the same protection and remedies as several other states and enact this legislation specifically permitting civil actions that allege attorney acts of fraud, intentional misrepresentation, deceit or collusion meant to deceive the court or any opposing party; see, e.g., Arkansas, California, Indiana, Iowa, Minnesota, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Wyoming.

We want to bring awareness to every citizen so that every state enacts similar legislation.

No legitimate purpose is served by granting attorneys litigation “immunity” either absolute or qualified; it is an unjustified protection for the unworthy. Litigation immunity undermines the legitimacy of the country’s legal process and constitutional protection.

Attorneys have a special duty as “officers of the court” to tell the truth! No attorney should ever be protected by absolute immunity or qualified immunity when they have intentionally violated their oath. We truly believe that no one is above the law!

WHY IS THIS BILL SO VERY IMPORTANT? THIS IS WHAT HAPPENED TO US:

We are two sisters, now senior citizens, who have lost our business, our livelihood, and our home. The Town of Salisbury's attorneys have covered up the illegal and unconstitutional actions of the Town, creating a downward spiraling effect-culminating in our impoverishment, loss of property, unconstitutional taking and imminent eviction from our home.

We opened our dream Mangia...A Cafe` Restaurant at Salisbury Beach, MA and were successful but shortly after we opened, we were bombarded with many thousands in sewer bills that we found out later we NEVER owed in the first place. We had paid our taxes and licenses, the Town misapplied our payments and charged us thousands of sewer bills that we did not owe. The Town closed our restaurant with no notice. We were never able to reopen.

We were forced to go to court, told the truth, gave the judges the proof that we had; we should have won! The Town's attorneys lied and concealed the truth and these attorneys won in every court using the same lies. Once these attorneys lied and won in the first court, every judge followed the first judge's decision, even though we proved the prior decisions were based on the Town’s fraud. The Town's attorneys told the judges a tangled web of lies!

We needed to find the Town vote to construct the sewer to prove we were not liable because we were new buyers who bought property already on municipal sewer with NO sewer lien, but we discovered so much more. It took us years to uncover that the Town vote was in 1982 for the EPA/State sewer project that cost $18 Million and was 100% federal and state grant funded so the Town had NO reason to charge us and about 1,000 other property owners the $7.8 Million betterment they charged, since the project was paid! By chance, we discovered that the Town hired attorneys to cover-up the Town's $7.8 Million Tax Fraud.

What happened to us, is the Town and the Town's attorneys concealed public records from us and the courts, misrepresented case law, state laws, and made deliberate falsification of facts; they told the judges BIG LIES so that they would win. The Town attorneys “fabricated” the relevant assessment vote was in 1992 to make us appear liable [even though we are not]; they had no proof. The Town attorney aided their Town witness to testify that this sewer project cost $80 Million and was 90% grant funded to justify the $7.8 Million the Town charged; again, they had no proof.

The REAL STORY is the U.S. EPA provided us with proof that the relevant Town vote was on May 17, 1982, which was 9 years before we bought the property in 1991; this proves we are not liable for the thousands of sewer charges that the Town had charged us plus thousands in interest. We received the proof, filed it with the Land Court to accept our new evidence, the judge would not accept the new evidence that we received from U.S. EPA, we lost again!

The Town started the eviction process using the same lies that they have continued to get away with so far!
