MPs will learn about good practice in Neighbourhood Planning and hear recent case law. Wicklesham Quarry already has the potential to inform our legislators as they consider this new field of planning law. Wicklesham Quarry, Pavlos Eleftheriadis has written, is a case which "raises many important points of principle of environmental justice." As we move closer to our aim of bringing a Judicial Review, it becomes clear how important this case is for many local communities, including those facing mineral proposals, where landowners agree to planning conditions for restoration, only to back out of them when the time comes to fulfill their commitments. Wicklesham Quarry is also an important case for testing the role of Localism. Is it a valuable contributory element of the planning system? Or a way of seeking to undermine it? Should developers whose proposals have been repeatedly rejected for inclusion in a Local Plan be able to pursue their aims through a Neighbourhood Plan? Even when these aims conflict with the strategic policies of a Local Plan for landscape, biodiversity, the protection of nationally designated sites, and development in the countryside? Should Neighbourhood Plan processes be led by those with strong financial interests in their outcome? No doubt these will be among the issues that MPs will be thinking about next week, and when they come to vote on the Neighbourhood Planning Bill.
