Lyons Live Music Noise Ordinance Revision
The Issue
Dear PCDC, BOT, Town Staff, Mayor Angelo, and Seargent Crist:
I am a supporter and customer of the Lyons Den. I am also a resident of Lyons.
I am requesting that the Board of Trustees and PCDC look into amending the noise ordinance (governed by Section 10-11-10 of the Town of Lyons Municipal Code) that is vague and severely affecting the livelihood of a local business. As you are aware, Denise and Randall Yarbrough have been issued 5 citations since October of 2019 to the present. These complaints were made by one individual in town. The basis for his complaints (from the ordinance) is that it is “unreasonable noise” that is “audible 25 feet from the source.” The code is vague and does not provide this business with clear instructions as to what the decibel range should be or what is considered “reasonable.”
I, along with many other concerned citizens want to support our local businesses and support live music. The Den has tried to mitigate and work with said neighbor to no avail. This one person’s efforts could shut down a local business. Is that fair to this business that is providing tax revenue for the town and local jobs? And, trying to be amenable to the issue?
We want the BOT, who represents the people of this town, to revisit the overlay plan and/or work on a new noise ordinance that is clear in its direction. For an example of a specific and clear noise ordinance, look at the town of Nederland’s.
