15 November 2017 THE RESPONSE OF THE INTERNATIONAL CRIMINAL COURT (ICC) IN THE HAGUE REGARDING MY REQUEST TO START PRELIMINARY PROCEEDINGS TO COMMENCE AN INVESTIGATION INTO THE ROLE THAT MR. JULIUS MALEMA PLAY IN RSA IN INCITING HIS FOLLOWERS OF THE EFF TO COMMIT ACTS OF VIOLENCE AGAINST A PARTICULAR ETHNIC GROUP IN SOUTH AFRICA. Our petition stands at – 131,730 supporters Dear Supporters of the PETITION TO STOP FARM MURDERS IN SOUTH AFRICA I was elated yesterday when I went through a pile of emails from supporters throughout the world and discovered a reply from the office of the INTERNATIONAL CRIMINAL COURT in THE HAGUE about my request to commence an investigation against MR. Julius Malema, the leader of the ECONOMIC FREEDOM FIGHTERS (EFF) who is inciting violence in our country against a particular ethnic group on a regular basis. The response read as follows: “The Hague, 13 November 2017 Dear Sir, Madam The Office of the Prosecutor of the International Criminal Court acknowledges receipt of your documents/letter. This communication has been duly entered in the Communications Register of the Office. We will give consideration to this communication, as appropriate, in accordance with the provisions of the Rome Statute of the International Criminal Court. Please note this acknowledgment letter does not mean an investigation has been opened, nor that an investigation will be opened by the Office of the Prosecutor. As soon as a decision is reached, we will inform you, in writing, and provide you with reasons for this decision. Yours sincerely, Mark P. He pressed upon me to study the Rome Institute and to find out how an investigation into human right abuses are done in terms of the Rome Institute. At the website of the ICC I read: “”The International Criminal Court (ICC) investigates and, where warranted, tries individuals charged with the gravest crimes of concern to the international community: genocide, war crimes and crimes against humanity. The Court is participating in a global fight to end impunity, and through international criminal justice, the Court aims to hold those responsible accountable for their crimes and to help prevent these crimes from happening again. The Court cannot reach these goals alone. As a court of last resort, it seeks to complement, not replace, national Courts. Governed by an international treaty called the Rome Statute, the ICC is the world’s first permanent international criminal court. Justice is a key prerequisite for lasting peace. International justice can contribute to long‐term peace, stability and equitable development in post‐conflict societies. These elements are foundational for building a future free of violence. ” These are most encouraging words. Mr. Julius Malema does not fear our South African courts. He uses court appearances as opportunities to incite even more violence amongst his followers. He laughs at the South African criminal justice system with impunity. I was very encouraged to read on the ICC website that “By supporting the Court, the countries that have joined the Rome Statute system have taken a stand against those who, in the past, would have had no one to answer to after committing widespread, systematic international crimes. The ICC will determine whether South Africa has failed to comply with its obligations under the Rome Statute when it failed or refused to arrest, detain and surrender Sudanese President Al Bashir despite the existence of two arrest warrants issued by the ICC and the repeated requests for cooperation by the ICC. These proceedings will further determine whether South Africa should be referred to the Assembly of States Parties or to the United Nations Security Council for non-compliance. Although the matter of withdrawal and the Article 87(7) proceedings are entirely distinct and independent from one another, it does indicate that the South African Government is facing challenges at every turn.” Our first president, Mr. Nelson Mandela, would never have dreamt of doing such a thing! Now I understand why Mr. Julius Malema operates with such impunity in South Africa. He does not fear that he would be held accountable in terms of the International criminal law. The ridiculous excuse given by our Minister of Justice and Correctional Services, Michael Masutha, why South Africa should withdraw as a signatory of the Rome Statute would be laughable if the matter wasn’t so serious. He argues that ‘it is contradictory for SA to arrest leaders wanted by the International Criminal Court (ICC), while they enjoy diplomatic immunity under customary international law and South Africa actively playing a role in fostering stability, peace, and dialogue in their countries.’ The true reason why the Zuma regime attempted to withdraw South Africa as a signatory of the Rome Statute was that it was obligated by it to arrest human rights criminals like Sudanese president Omar Al-Bashir should he be on South African soil. “ Bashir was indicted in 2009 by the ICC for alleged genocide and war crimes in Darfur. Allowing him to escape was a kick in the face of the 400,000 people who have died in the ongoing conflict – and the 2.5 million who have been displaced. Over the past few years, pressure from African leaders criticising the ICC has grown, with many claiming its cases target African leaders only. In December Ugandan president Yoweri Museveni, who has been in power since 1986, said the ICC was a “tool to target” Africa. Rwanda’s president Paul Kagame has accused the court of “selective” justice. This is in some sense true: since its establishment in 2002, the ICC has heard 22 cases and indicted 32 individuals. All of them are African. South Africa, though a signatory to the Rome Statute through which the court was established, has lately joined this chorus, with the governing ANC saying on Saturday: “The ICC is no longer useful for the purposes for which it was intended – being a court of last resort for the prosecution of crimes against humanity.” While this stance may have endeared the country to the rest of the African Union – where it seeks to be a significant player – it reveals a troubling contradiction: signatory to the Statute on the one hand, while flirting with those who seek to defy its precepts on the other” https://www.theguardian.com/world/2015/jun/16/omar-al-bashir-escape-south-africa-african-union The ICC did not stop to prepare for the prosecution of a human rights criminal like Sudanese president Omar Al-Bashir just because Sudan has not signed the Rome Institute. The case is now in pre-trial stage.
