The Right to Play
The Right to Play
The Issue
To the Condo Board and Property Management of 6020 Derry Rd:
We the undersigned, residents and owners, are advocating for a community that is safe for everyone, where property is protected and children are welcome.
While we understand the need for protection of property, a total ban on children is not the solution, and violates the rights of children according to the Ontario Human Rights Code Section 2(1).
The Ontario Human Rights Commission has clearly addressed this issue in its Policy and Guidelines on Discrimination because of Family Status Section X.3.3 and 4.
The onus is on the landlord, in this case the Condo Board, to prove that they have exhausted all other solutions before a full ban is accepted as the only viable option with regard to children’s safety. In this situation, this test has not been met as no other viable options have been presented, and no community consultation has taken place.
While liability was cited at the AGM on July 29th 2026 as a primary concern, the liabilities of a condo corporation do not supercede the rights of children, young families, and landlords.
Additionally, if liability is a concern yet speed-bumps were not put in during the renovations of the roads in 2021 and 2024 to protect all residents and pedestrians, then liability cannot be considered as the main reason for a ban on children at play, and instead it becomes an issue of the violation of rights.
Therefore, in order to achieve our collective goal as stated above, and ensure all voices are heard and a compromised solution to all concerns is found, we the undersigned are calling for the following:
1) A Community Town Hall where all voices can meet at the table to discuss this issue, and where the voices of children and families, as well as other residents and owners, can be heard and multiple options for a solution(s) can be explored rather than an outright ban on children at play. This should include discussion of creative solutions and the possible installation of safe play areas.
2) A policy that ensures the rights of children and families are upheld while also acknowledging the conditions of liability, and rights of property owners to establish clear boundaries for equal and fair use of common spaces. This policy should make clear that police and emergency services are not to be called unnecessarily on young children, and only in the case of legitimate emergencies.
3) The installation of Speed Bumps into the complex using the current available funds in order to ensure the safety of children and all residents from incoming and outgoing traffic, and reduce the aforementioned liability of the condo corp, as this is more of a current liability concern than children at play.
We hope this issue can be resolved by coming together as a community, and without further escalation, to ensure the safety, harmony, and enjoyment of our community for all residents.
