

The People of South Africa vs Debt Collectors
The Issue
We, the citizens of the Republic of South Africa, herewith exercise our Constitutional Rights to an environment that is not harmful to our well-being, our right to protection of dignity and privacy and our right to just administrative action.
As most of us are subjected to debt and the high cost of living, we remain unprotected against the abuse, harrassment and deception by Debt Collectors practicing in an unlawful, wrongful and unethical manner.
We therefore demand the amendment of legislation related to Credit Agreements, the protection of privacy and the administration of justice to prohibit the collection of and criminalise the proceeds of debt which have been ceded and/or sold on by banks, retailers, and other credit providers.
We intend to present the relevant authorities with proposed amendments to the National Credit Act, 2005, the Protection of Personal Information Act, 2013, the Legal Practice Act, 2014, the Consumer Protection Act, 2008, and any other statute which is not aligned to Chapter 2 of the Constitution of the Republic of South Africa.
We further intend to put an end to deception by law firms operating as Credit Providers and Debt Collectors, such as MBD Attorneys, Norman Bisset and Associates, Norton Attorneys, SDK Attorneys and others operating in the same manner and form.
We intend to launch a Class Action in the Constitutional Court, via the High Court, to declare the practice of Debt Collecting of Prescribed, and/or sold-on debt, illegal and an offence punishable by criminal law.
