The Northern Ireland Employment Tribunal Is Failing Disabled and Vulnerable Litigants.
The Issue
In England, the Judicial Conduct Investigations Office recently agreed to investigate an Employment Judge accused of bullying and intimidating claimants over seven years.
In Northern Ireland, there is no such accountability.
Self-representing litigants — many disabled, traumatised, or managing mental health conditions, while being denied legal aid — go up against experienced legal teams for well-resourced employers with no "equal footing," despite that phrase being bandied about by Tribunal staff.
Reports and complaints describe judges and barristers who sneer at, shout at, ridicule and belittle vulnerable, unrepresented litigants.
Bundles sabotaged deliberately. Extreme, almost comically overt bias favouring Respondents. Misogyny. Intimidation. Palpable irritation and anger from Judges during hearings (only towards litigants) and deference towards Respondnets. No adequate judicial training on mental health symptoms.
Complaints about judicial conduct are reviewed by the very judge complained about. They go nowhere.
A system that "polices" itself and protects itself — at the expense of the health of those whose statutory rights it is paid to uphold.
Litigants have described suicidal ideation, severe anxiety, and losing valid cases simply because they could not navigate a system stacked against them.
Complaints against tribunal judges and the Tribunal President go nowhere. Currently, President Maxine Orr has total impunity, with zero regulation or scrutiny from anyone.
The Lady Chief Justice says it's a Department for the Economy matter; the Department says it's a judicial matter. In that vacuum, the Tribunal operates with no scrutiny at all.
This pattern has been documented for years — in the Buggy Report (2020) written by a Judge who was inside this exact system for 30 years, and also two Ulster University reports by Professor Gráinne McKeever (2010, 2018) Also, a 2024 briefing to the Economy Committee.
None of the recommended reforms have been implemented. All of this is well known by the relevant officials and Judges.
Why? Where is the safeguarding? State bodies have a duty of care.
We are demanding:
*The First and deputy First Ministers establish a formal accountability framework for the Tribunal President
*Justice Minister Naomi Long drive structural reform of the Tribunal system
*Economy Minister Ms Archibald implement the outstanding report recommendations without delay
Tribunal President Maxine Orr publish the missing annual performance reports and commit publicly to reform, in line with the Tribunal's legal duty to accommodate disabled litigants
*Self-representing disabled litigants be given access to legal aid
*No public body funded by taxpayers should be allowed to operate this way, in breach of its own duty to safeguard vulnerable adults and protect life from self-harm and suicide.
