Some BC RCMP officers aren't fulfilling their duty to conduct investigations properly and enforce laws fairly.
The Core Issue:
BC RCMP leadership is not ensuring their officers act within legal boundaries. Defence attorneys are needed to provide oversight. As it stands, any unchecked BC RCMP officer can file charges and infringe on Charter Rights against lower-income individuals without consequence.
Legal Aid BC only offers assistance if the accused agrees to an early resolution (plea or alternative measure), leaving the falsely accused to choose between admitting to a crime they didn't commit or facing the system alone. Without an attorney, they risk facing unchecked authority for up to 18 months until charges are dropped.
I am a retired low income senior, whose noise dispute with new neighbours resulted in entirely false Criminal Harassment and Criminal Mischief charges. There must be thousands of cases like it.
Legal Aid BC ensures no one pleads guilty unless the police respect Charter Rights. This system upholds prosecution integrity but mainly for those who are ready to concede.
Why not ensure the accused have a defence before urging them to accept a plea, thus protecting them from potential abuse?
We call on British Columbia's government to resolve this critical issue by boosting Legal Aid BC's budget by 10% to address actual needs.
Allocate an average of $3000 annually per case for defence services, supporting over 3000 low-income individuals. Through a secure portal, offer contracts at market rates to defence attorneys willing to provide these services.
The advantages of financing a defence include saving prosecutors' time, restoring trust in the justice system and police, and protecting the Charter Rights of the vulnerable.
Use the Solicitor General's budget as a safeguard against wrongful prosecutions and to encourage BC Police Reform.
A defence attorney can ensure charges that should be dropped are dropped, sparing the wrongly accused from waiting months for a resolution. Many accused depend on limited pro bono help or lack representation, leading to unfair outcomes.
