Still Human in Brighton & Hove
2 oct. 2017 — https://chuffed.org/project/still-human-uk-client-legal-funding We are nine days away from an anniversary – on 11 October 2016 ITV ran their first story about Robert Carver and in their right of reply Brighton and Hove City Council promised ITV the matter would be resolved in a matter of weeks. Not long ago ITV ran their third item on Robert Carver and the lack of progress, and once again BHCC made a solemn promise that the problem will be resolved in a matter of weeks. We are not holding our breath. A major problem is that BHCC has shown again and again that it is willing to make all the promises in the world but sees no valid reason to actually keep these promises, or adhere to the Law. Late this summer another such promise was made, this time they would heed the letters of independent NHS experts. However, when they didn’t find those letters to their liking they decided that somehow medical needs and care needs were two entirely separate matters which justified backtracking from that solemn promise. Rather than go over all the familiar grounds again, let’s ask a question: What does it say about BHCC that they have had six years to adhere to the Care Act but still haven’t managed to do so? BHCC seem beyond accountability and reproach. The Local Government Ombudsman, in decisions now made, has made entirely clear that anything BHCC says or claims cannot be doubted, the Council simply cannot be wrong and the LGO decisions merely paraphrase Council arguments, even where it is blatantly clear the Law has been broken. So far the Council has ignored or swept aside no less than eight safeguarding concerns raised by numerous medical experts and the emergency services. We could put in a ninth, but the very person such a safeguarding concern would be directed against, is the same person on whose desk this safeguarding concern would land and who would get to decide whether to take the concern seriously or not. Again we’re not holding our breath; they seem to have all the avenues covered. We recently spoke to Debbie Abrahams, Shadow Secretary of State for Work and Pensions, who was on the committee which formulated the Care Act and she was appalled at hearing just how BHCC interpreted the Care Act. At the recent Labour conference, she said that she had heard of “dozens and dozens” of cases of assessment reports “not marrying at all with the detail in the assessment, the medical records that were supplied and so on. This cannot be allowed.” She also indicated that professionals ignoring medical evidence supplied by independent parties should be held to account. That puts local Labour Councillors in the awkward position that a Labour victory in the next election will mean their own actions will be scrutinised, for they have condoned, excused or ignored local cases in which basic human rights are violated. The actual violations may be conducted by their masters, the permanent Council officers, but the Councillor’s collaboration in this can be evidenced and at some point, surely, they will have to account for their actions. Robert continues his fight and struggle for justice. Next week, on the anniversary of that first ITV report, he will meet with Debbie Abrahams in the House of Commons, courtesy of the Independent Disability Council, and there is talk of the United Nations. Having exhausted all other possible means, he is now also focusing on legal action. He wants those responsible for deliberately furthering his deterioration to be held accountable somewhere at least. Had they acted in a timely fashion and heeded the medical experts, who warned them many years ago that Robert would suffer greatly if they did not meet their legal obligations, he might well NOT be in a wheelchair today, and been able to work on his physical rehabilitation so that he could maintain his ability to walk. When such physical therapy was recommended by the NHS, by the way, Adult Social Care claimed that THEY didn’t think physical therapy strongly recommended by NHS experts was relevant, and suggested that Robert join a talk-group instead. This is just one of a hundred examples where medical evidence was ignored, twisted or dismissed because medically untrained BHCC staff claimed to know far better than NHS experts what was good for Robert. The results of this psychobabble therapy is that Robert is now tetraplegic, getting ever closer to being wholly immobile, and also losing the power of his speech – and closer to a now pretty much inevitable premature end of his life. The Council would probably rejoice if Robert were to die, but he is hanging on, wanting people to know how disabled people are treated in Brighton & Hove, and hoping against all odds that someday both elected Councillors and permanent Council Officers will have to stand up in court and swear an oath to tell the truth and nothing but the truth. No more regulations to hide behind, no more other departments to pass the buck to, no more convenient maze of procedures to muddle the truth with…just plain questions and no choice but to provide plain answers, to finally justify six years or bureaucratic blunders, personal dislikes, and lies told simply to spend a bit less money on severely disabled people, presumably to spend on grand projects like the i-360 and the never-ending overpayments to big businesses they associate with. Let’s light a figurative bonfire which will give them cause to regret their reprehensible behaviour. Let’s let the Council know that not all the public support the despicable practices which have apparently become the norm within BHCC. If and when we have finally achieved justice for Robert Carver, we will proceed along that route on behalf of many others in Brighton & Hove who are treated as unimportant subhumans by this Council.
