Motion For Leave To Appeal From Orders Of The Appellate Division

Please review and rule on my motion, which asks for permission to bring my appeal containing an issue of statewide importance. This issue is chronic distortion of a past ruling, of the New York Court of Appeals, made in a case with extraordinary circumstances, as explained in my Memorandum of Law. Derived using poor logic and irresponsible sophistry, the resulting case law has been used for more than thirty years to justify routine imposition of excessive and onerous financial obligations on non-custodial parents, often with disastrous consequences, as described in the New York Times' article “Skip Child Support. I send this motion directly to the Court of Appeals because it is the proper venue to review such case law which is not consistent either over time or among judicial departments. I will not bring this motion to the Appellate Division because they are neither fair nor logical in this case. The Appellate Division has dismissed my appeal arbitrarily and has ignored my complaint about newly discovered conflict of interest for the judge presiding over my appeal, as explained in my motion papers.

This motion and required documents, complying with pertinent requirements to the best of my ability, have been delivered to you by UPS, tracking number 1Z5AR2550303263353, on April 21st 2015. The mailing contains the complete motion papers bound as one book with affidavit of service at the end and money order for the motion fee under the front cover, six bound copies of these motion papers, the Appellant's Brief and Appendix, Brief for the Plaintiff-Respondent, and the Reply Brief.
