The Name Change is prohibited by the Legal Contract Terms of the Contract between the Joseph E. Brown Family and the Atlanta Public Schools/Board of Education created in 1923 where the Brown Family donated the land for the school stipulating that the school had to be named for Joseph E. Brown as a condition of its donation. Mr. Brown was the first Atlanta Public School President (1869-1888) and had given money to help form the APS, was a former Georgia Governor four times, and a former U.S. Senator. The Atlanta Public Schools had approved of Naming a School after Joseph E. Brown earlier that year.

Besides being a Legal Contract Violation, the Name Change would cause a loss of family heritage for the Brown Family, a loss of esteem and history for the many thousands of Alumni who attended the school from 1924 until the present, and a loss of heritage for the surrounding community.
