This petition is the result of the backlash building against Texas Toll Roads. For 20 years. The State of Texas has allowed and encouraged the development of a complicated, abusive and convoluted Toll Road infrastructure. Arguably "negligent" legislation, enacted by lawmakers in Austin has enabled regional toll operators to "create" their own, individual operating regulations - many of which are unique to each regional toll system. This "lack of control and regulation" has directly resulted in a Toll Road System that is ABUSIVE to citizens.
The operating structure of the Toll Road System across the entire State of Texas MUST change. Current state laws do not adequately regulate Toll Road Operations or protect citizens from the "pitfalls" of the current laws, regulations and operating nature of Toll Infrastructure.
The result - True harm is coming to Texas citizens in the form of egregious fines, harassment, loss of driving privileges, an inability to register vehicles, arrests financial abuse and other circumstances that are due, not because Texans are outlaws trying to abuse the Toll system but instead, caused directly by the lack of proper regulation and oversight to prevent a Toll System that is NOT citizen Friendly.
There is a general consensus among ALL Texans is that lawmakers are turning a blind eye to the facts presented to them. They are unwilling to address the pleas of the people and the people feel helpless and violated.
There is no charter within the Texas Constitution enabling or allowing our government to create, encourage and operate a mode of transportation that is incompatible with the Article 1, Section 2 of the Constitution.

Therefore, we the people of the state of Texas are informing you, our elected officials, that the Current system of the Toll Road Infrastructure in Texas is NOT operating in a mode that is strictly beneficial to the citizens of Texas. Instead, lawmakers have created a system fraught with abusive, corrupt, unethical and Unconstitutional practices. These abuses and non-beneficial practices have repeatedly been presented to State Lawmakers who have ignored us, refused to listen to us and failed to act in accordance with the very charter of your office under the State Constitution.
TOLL ROADS ARE NOT CITIZEN FRIENDLY!
We the people DEMAND that State legislators listen to, and address the litany of Unconstitutional, Unethical, abusive and non-beneficial "causes" of Unrest surrounding Toll Roads in Texas.
WHAT WILL RESULT
As an elected official, you have a responsibility to sensibly look out for the best interests of the people, to act in a manner that is in accordance with the best interests of the People and therefore, to correct the egregious operating concerns outlined herein.
If you fail to act, We The People are prepared to file what may become the largest Class Action Lawsuit in Texas History in Federal Court to seek legal remuneration including injunctive, compensatory, special and incidental damages.

Toll Roads are NOT citizen friendly. Texans are growing increasingly dissatisfied with the system as a direct result of inappropriate, abusive and unconstitutional operating methods enabling the Toll Roads to operate in a manner that is abusive and unjust. Public opinion is that there is great corruption occurring throughout the State surrounding Toll Roads. We have, through significant investigation uncovered that the State of Texas has likely “created” the public opinion as a direct result of negligent regulation resulting in an abuse of Texans using the Toll Roads.
Many MAJOR flaws exist resulting in accidental “entrapment” of honest Texans, using Toll roads with good intent, becoming victimized as a direct result of the poorly constructed Toll regulation laws. Toll Authorities are unethically and potentially criminally, “exploiting” the lack of regulation and abusing Texans, resulting in a general consensus that Toll Roads are NOT Citizen Friendly.
A litany of “situations” proximally caused by poorly constructed legislation results in what is perceived as an ABUSE of Texas citizens. These potentially unethical and illegal “exploits” manifest themselves by criminalizing Texans for their federally Protected Right to Drive, resulting in true emotional and economic harm. The result – Angry Texans demanding change!
For example; toll fine collections occur in Harris County in an alarming and egregious manner through an Unconstitutional, unethical and immoral method that is depriving citizens of their right to due process of law – even eliminating the statute of limitations in the unconstitutional practice under the 7th Amendment of the US Constitution AND the Article 1 Section 15 of the Texas Constitution.
We have identified that a majority of “exploits” are “generated”, by the lack of regulation, through inter-agency reciprocal agreement circumstances however; inter-agency exploits also exist. The result – Texans left feeling helpless or outraged. Many of these concerns have been brought to your attention without action. For example; in 2016, a letter was sent by certified mail describing these concerns including Texas Attorney General Ken Paxton. That letter was signed, at the time, by 13,000 Texans asking Ken Paxton for a full investigation into the allegations. Additionally, we asked Governor Abbott specifically to command Ken Paxton to issue an opinion on the perceived egregious fines and fees being charged above and beyond the toll use fees resulting from the exploits. No investigation was conducted and no opinion was rendered in response to the letter from Texans.
Also discussed in the letter sent in 2016 was a proposal to lawmakers to host a referendum to review, investigate, discuss and propose solutions to the allegations and perceived mistrust by the public and to generate swift action to correct, any injustice uncovered and further address any perceived public perception of abuse and unethical conduct. James Bass agreed to host such a meeting however; no other state official bothered to respond.
The petition, now signed by 42,396 Texans is again extending the State an olive branch, requesting that lawmakers address our concerns and generate legislation to close the exploits, restoring the public trust and addressing any illegal, unethical or Unconstitutional financial seizures including returning any money that was proven to have been seized illegally or unconstitutionally and publicly admonish impropriety uncovered, apologizing to the public and promising to drive swift corrective action.
Therefore, it is the opinion, of the people that although legal, and generally tolerated, are undesirable and prefer that Toll Roads be eliminated or several curtailed. We recognize that Texas has the largest road infrastructure and one of the lowest Gas Taxes in the Union. Regardless of the need and the mechanism that the State of Texas utilizes to satisfy transportation needs, the citizens demand that that mechanism be considerably better regulated and administered in order to reasonably guarantee that exploits and abuse cannot exist in that system.
We The People, having “all political power” inherent in us, again, extend an olive branch to you, our elected leaders, where we are united in our cause, to correct flaws in state transportation systems guaranteeing that they are instituted for the “benefit” of Texans with reasonable protections preventing potential injury proximally caused by and resulting from the poorly constructed and administered state laws regulating Toll Roads.
Having duly notified you of these issues, we the people await your response.
