Award-winning San Jose chef pleads no contest to child porn charge By Linda Goldston   lgoldston@mercurynews.com Posted: 12/17/2010 05:44:48 PM PST Updated: 12/18/2010 03:59:24 AM PST      Emile Mooser, the award-winning chef and former owner of a landmark San Jose restaurant that still bears his name, has pleaded no contest to a felony charge of possessing child pornography. Mooser, 76, had pleaded not guilty to the charge but changed his plea last week, authorities said. The plea means he will have to register as a sex offender for the rest of his life and faces up to three years in prison. "The evidence was very strong," said prosecutor Kevin Smith. "The federal authorities monitor child porn sites, and they found him through some transactions." According to federal documents, Mooser spent nearly $400 for access to child pornography websites. The documents alleged that Mooser used a PayPal account at least five times in 2006 and 2007 to access various illegal sites, including one called "1001 Desired Angels." When authorities served a search warrant on his home in January 2009, they seized Mooser's computers and found a disc with 316 images of underage girls in various states of dress. None of the girls appeared to be more than 12 years old, and many of the photos contained graphic images of the girls' genitalia, according to documents filed in court by the Department of Homeland Security's Immigration and Customs Enforcement. There were dozens of images of naked children, not engaged in sex acts, Smith said. Mooser's attorney was out of town and did not immediately return a call from the Mercury News. Because he pleaded no contest, there will not be a trial. The maximum penalty for the one felony count is three years in state prison, but defendants in such cases often are sentenced to a year in county jail. He'll also have to register as a sex offender.   Sentencing is likely to be in March. Mooser has been out on bail since his arrest. In addition to the federal charge, Mooser also has been hit with a lawsuit filed Oct. 22 by the new owners of Emile's Restaurant. Briand Properties, Morgan Kane Food Services and Michael Dorian allege that there were misrepresentations and concealment of material information by Mooser at the time of the sale in January 2007. The suit seeks $2.1 million in damages. Attorney Marco Campagna, who represents the new owners of the restaurant, said the purchase included "the trade name Emile's Restaurant." "Mr. Mooser has not been an owner since that time," Campagna said. "The representatives of the new owners would like the general public to understand that they were unaware of, and certainly did not sanction, the conduct that led to Mr. Mooser's criminal arrest and recent no contest plea." Campagna said publicity surrounding the case "has caused financial hardship to Emile's Restaurant," but he added the new owners are committed to restoring its prominence. Emile Mooser deserves jail time for downloading child porn.
Child porn is the depiction of children being sexually abused, tortured, and raped. If we as a society let a person off with a slap on the wrist, How are we going to let them know we are serious about keeping our children safe? We have to demand justice when the evidence is clear and in this case it is.

Our sex crimes against children internet crime police officers and vice detectives are over worked, and can't possibly handle all the leads they come upon when found. It takes time, energy, and money to bring a case to trial such as Emile Mooser's to try and keep our children safe. The least our courts can do is punish the offenders to the fullest extent of the law because our citizens demand justice for his crimes.

Having sex with children is wrong and buying child porn for the sexual gratification is just as wrong too! We know that pedophiles are often well liked members of the community preying on children overseas such as Cambodia or other places. Emile Mooser has strong contacts in both places.

Our sexual offender problem is not getting any better, it is getting worst. One out of three children will be sexually abused before she/he is 18, what does that say about our criminal justice system? What we are doing is NOT working! We need to DO more and keep them locked up because they DO not change! They are only sorry during three times in their lives: 1. When they get caught 2. When they go for sentencing 3. I say we need to put them in jail when we find them for as long as the law allows. Our children deserve to be safe, loved, and cared for without fear of being raped, kidnapped, or tortured for the like of Emile Mooser. Looking at child porn for the sexual gratification is just the same as making it because he paid to have a child abused by buying child porn!
