The Issue

We are calling on Amazon, Walmart, Target, Tik Tok Shop and other retailers and online marketplaces with the ability to contact previous purchasers to adopt a simple consumer safety notification policy:

When a child’s product (such as a toy) is removed from sale because of a credible serious safety concern, notify the people who already purchased it.

Removing a dangerous product from a store or online marketplace protects the next customer. Notifying previous purchasers protects the families who already brought it home.

Today, retailers and online marketplaces can often identify exactly who purchased a product and communicate with those customers directly. Yet when a product is removed because of a serious safety concern, previous purchasers may never know if or why it disappeared.

That can leave potentially dangerous products in homes for months or years while consumers remain unaware of information that could help them protect their families.

A formal recall should not always have to be the first time a family learns that a product they own may present a serious hazard.

We are not asking retailers to send warnings every time a product listing disappears. We are asking them to establish reasonable policies for notifying previous purchasers when:

  • A product has been removed or sales have been stopped because of a credible serious safety concern;
  • The hazard could result in serious injury or death;
  • The retailer or marketplace has the ability to identify and contact previous purchasers.

These communications can clearly explain that an investigation may still be underway and distinguish an interim safety notification from a formal recall.

Awareness gives families the opportunity to act. And sometimes, a warning delivered at the right time can prevent the next injury entirely.

This practice is especially important in today’s global marketplace. Some manufacturers and sellers are located overseas, cannot be reached, or fail to respond to safety regulators. In those situations, the retailer or online marketplace may be one of the only entities capable of quickly reaching the families who actually purchased the product.

Consumers trusted the retailer enough to bring that product into their home. That relationship should not end at checkout, especially when a warning could prevent an injury or save a life.

Prevention works when families receive the right information at the moment it matters most. But a warning can only protect a family if they trust its source. Retailers have already earned that trust at the point of purchase, and that trust gives them a powerful opportunity to turn a safety warning into action that can prevent injury and save lives.

Imagine learning only after your child is seriously injured, or after you have buried them, that the product that hurt your child had already been pulled from shelves over serious safety concerns. This is the current reality for families.

Retailers are uniquely positioned to close this devastating gap in product safety. They know what was sold, who bought it, and how to reach them. They have built extraordinary systems for communicating with customers about orders, deliveries, promotions, subscriptions, and recommendations.

We are asking them to use that same capability for safety.

Because when people’s safety is at stake, silence should not be the default.

Removing a dangerous product protects the next customer.

Warning previous purchasers protects the families who already brought it home.

If you know enough to stop selling it, and you know who bought it:
