Stop the frivolous lawsuit against Strava
The Issue
Cyclists unite
Two years ago, a Berkley man was killed while descending on his bike, 10+ miles an hour over the posted speed limit.
William "Kim" Flint admittedly loved to ride fast, tweeting just two weeks beforehand: "49.3 mph, on a bike. How I find religion on Sunday morning."
Yesterday, on behalf of his family, attorney Susan Kang filed suit in a San Francisco court against Strava, the makers of the timing software Flint was using, alleging that they contributed to his death, stating that, “They assume no responsibility. They don’t put cones out. They don’t have anybody monitor and see whether a course, or a specific segment, is dangerous.”
Ms. Kang's filing of this lawsuit embodies the culture of frivolous lawsuits that have killed the notion of personal accountability, impinge on our personal freedoms, and cost us tens of millions of dollars in liability insurance.
Ms. Kang is three years out of law school, working for a small personal injury firm in Oakland that does not even have its own website. Her obvious attempt to cash in on this death is shameful and frivolous.
