Supreme Court: Reject the Emergency Bid for a National Trans Sports Ban
The Issue
The U.S. Supreme Court is being asked to settle one of the most debated questions in school sports before the case behind it has even been fully heard.
This month, the Alliance Defending Freedom (ADF), a conservative legal group, filed an emergency request with the Supreme Court in a Washington state high school wrestling case. ADF wants the justices to step in now, while the appeal in a lower court is still moving forward, or to jump the line and review the case on a fast track. A senior ADF lawyer has said the larger goal is a ruling under Title IX, the federal law that bans sex discrimination in schools, that would require girls’ and women’s sports to exclude transgender girls and women. He said he hopes it would force the 23 states that now include trans athletes to change their rules.
Emergency requests like this one go through what is often called the shadow docket. It lets the justices act quickly, outside the usual schedule of written arguments and courtroom hearings. That speed fits real emergencies. It does not fit a question that would reach students in every state while the basic facts are still in dispute.
And the facts are in dispute. The case centers on a wrestler’s allegation that a transgender opponent assaulted her during a match. According to reporting by Vox, local prosecutors looked into it and declined to file charges because they could not prove a crime beyond a reasonable doubt. The school district’s own review is still open.
Whatever someone believes about trans athletes, a decision this big deserves a full trial, a complete record and a public hearing. Families on every side deserve a ruling that is careful, not rushed.
Sign the petition to urge the Supreme Court to reject this emergency request and let the case be heard in full before any national rule is set.
