UNICEF Representative in Iran

More than three months have passed since nationwide protests and uprisings of people all over Iran. The Islamic Republic Regime initially met civil demonstrations with violence and severe repression. According to Amnesty International, on December 9, 2022, more than 44 children have been killed so far by Security forces. Many teenagers and children have also been arrested or beaten during street protests. Security Forces including the Police and Islamic Revolutionary Guard Corps (IRGC) have terrorized students throughout the country by entering schools and then threatening, beating, arresting, or kidnapping students in different cities of Iran, especially in small towns. 

Iran is one of the signatories of the International Convention on the Rights of the Child. According to the law authorizing the Government of the Islamic Republic of Iran to accede to the Children's Convention (dated March 1994), the provisions of the Convention are considered part of the law. Article 13 of this convention emphasizes the right to freedom of expression and to seek, receive and impart information by the child. Article 15 recognizes the right to demonstrate as one of the apparent rights of children through freedom of assembly.

We are now requesting the following:

• We demand an immediate unconditional release of all children abducted or detained;
• Conduct complete investigations into cases where children have been killed;
• Follow up on any intervention and presence of military and security forces in schools;
• Follow up on the situation of creating an atmosphere of terror through threats or putting the information of protesting students by the school, administrators, and agents to security institutions;

Lastly, we request that UNICEF take immediate and appropriate action regarding the current situation. The need to increase the protection of schools is paramount so that they can remain to learn safe havens enabling boys and girls to fulfill their right to an education. A follow-up with the capacity to monitor and report the abduction of children is instrumental in ending and preventing the violation in the future. With UN guidance to address this violation, an action plan can be put in place to provide protection and prevention for the future.

بیش از سه ماه است که از آغاز اعتراضات سراسری و خیزش مردم در سراسر ایران می گذرد. اعتراضاتی مدنی که از همان ابتدا با خشونت و سرکوب شدید توسط رژیم جمهوری اسلامی مواجه شد. بنابر اعلان سازمان عفو بین الملل-مورخ 9 دسامبر 2022- تاکنون 44 کودک کشته شده اند. بسیاری از نوجوانان و کودکان نیز در جریان اعتراض های خیابانی بازداشت شده یا مورد ضرب و شتم قرار گرفته اند. همچنین برخورد خشونت آمیز و وحشت آور نیروهای انتظامی، نظامی (سپاه ) و امنیتی با دانش  آموزان از طریق ورود به مدارس، تهدید، ضرب و شتم، بازداشت یا ربودن برخی از دانش آموزان در شهرهای مختلف ایران-به ویژه شهرهای کوچک تر و دور از مرکز که از اطلاع رسانی کامل نیز محروم هستند- بسیار نگران کننده است.

از آنجا که ماده 13 کنوانسیون حقوق کودک بر حق آزادی ابراز عقیده، آزادی جست و جو و دریافت و رساندن اطلاعات توسط کودک تاکید دارد و ماده 15 نیز حق اعتراض را به عنوان یکی از حقوق بدیهی کودکان از طریق آزادی تشکیل اجتماعات به رسمیت می شناسد و ایران نیز از امضاکنندگان این کنوانسیون بوده و بنابر قانون اجازه الحاق دولت حمهوری اسلامی ایران به کنوانسیون کودک (مورخ اسفند 1372)، مفاد ،کنوانسیون در زمره قانون تلقی می شود

از آن مقام درخواست داریم درخصوص موارد ذیل اقدامات مناسب و فوری انجام دهد:

•   پیگیری وضعیت همه کودکان ربوده یا بازداشت شده تا آزادی فوری همه آنها
• انجام تحقیقات کامل و پیگیری پرونده های کودکان کشته شده
• موضوع دخالت و حضور نیروهای نظامی و امنیتی در مدارس
•  موضوع استفاده از روشها و ابزارهای خشونت آمیز علیه کودکان معترض 
• موضوع ایجاد وضعیت فضای رعب و وحشت از طریق تهدید یا قرار دادن اطلاعات دانش آموزان معترض توسط مدیران و عوامل مدارس به نهادهای امنیتی

بدیهی ست  افزایش امنیت مدارس حائز اهمیت است، چراکه دختران و پسرانمان نیاز به محیطی امن برای یادگیری و بهره مندی از حق آموزش دارند. همچنین پیگیری موضوع، گزارش و نظارت بر موارد فوق در پایان دادن به خشونت و جلوگیری از ادامه آن در آینده موثر خواهد بود و با رهنمودهای سازمان ملل برای رسیدگی به این موارد نقض حقوق بشر، می توان یک برنامه عملی برای حفاظت از کودکان و پیشگیری از بروز موارد مشابه در آینده تهیه کرد.
