What happens when a family law judge, presiding over thousands of divorce cases, is investigated for judicial misconduct, abuse of power or judicial retaliation? What happens when a judge is investigated for a disability, drug addiction, disability or dementia? Will orders the judge made while biased or incompetent be voided? Under the new Family Code Section 218 will divorce cases already settled see a reopening of discovery ? Santa Clara County is about to find out as it is rumored for a third year in a row that Mary Ann Grilli, the county's longest sitting family law judge may be facing some challenges in the months ahead. For those who have nicknamed Grilli , the " Gridlock Witch of Family Court" or worse, it may not be time to get your hopes up of getting rid of Grilli's corruption legacy just yet. Court clerks inside the courthouse informed the " in crowd" of lawyers that her cases are being reassigned to Judge Scott, who was recently publically admonished by the Commission on Judicial Performance. Other cases are going to Judge Towery, who was run out of the State Bar's senior trial counsel position in a " cesspool" of ethics violation charges. Towery may have been groomed by Grilli and may be the worst of the bunch, given his history of ethical issues raised over the course of his career. Is Santa Clara County imposing the worst and most corrupt judges on citizens merely seeking a divorce ?
