Adults should generally remain free to purchase lawful products, and responsible local businesses should be able to operate without being stigmatized simply because they serve an adult clientele.

At the same time, businesses selling age-restricted or sensitive products have an obligation to follow strong standards for safety, transparency, age verification, and responsible merchandising.

This petition originally raised concerns about both synthetic or intoxicating cannabinoid products and merchandise sold through some adult-oriented retailers. Its purpose is not to condemn lawful adult businesses or their customers. The goal is to address specific products and practices that may create identifiable risks to consumers or the wider community.

We ask state and local officials to strengthen enforcement of existing laws and evaluate whether additional safeguards are needed for Pensacola-area businesses selling intoxicating hemp products, smoking or vaping products, and adult-oriented merchandise.

Priorities should include:

• Strong enforcement of age restrictions for intoxicating hemp and other age-restricted products.
• Compliance with product-testing, labeling, packaging, and certificate-of-analysis requirements for hemp-derived cannabinoid products.
• Enforcement against products that are contaminated, dangerously mislabeled, illegally marketed, or otherwise fail applicable safety standards.
• Clear separation of age-restricted products from merchandise or marketing likely to appeal primarily to children.
• Routine compliance inspections using fair and consistent standards.
• Accurate information for consumers about the ingredients, potency, and risks of intoxicating cannabinoid products.
• Appropriate enforcement of applicable laws governing tobacco, vaping, smoking accessories, controlled substances, and related merchandise.
• Careful legal scrutiny of sexualized products or replicas that depict minors or unlawfully reproduce an identifiable person's likeness.

The presence of adult merchandise, smoking accessories, or hemp-derived products should not by itself be treated as evidence that a business is harmful. Enforcement should instead focus on specific violations and measurable risks.

Likewise, regulation of sensitive merchandise should be precise. Lawful products intended for consenting adults should not be prohibited merely because some people find them offensive. Products involving the sexual depiction or imitation of minors, nonconsensual use of a person's identity or likeness, or other unlawful conduct present different concerns and should be addressed under appropriate law.

Pensacola can support legitimate local businesses while still expecting businesses serving age-restricted markets to operate responsibly.

We ask local and state officials to use evidence-based regulation, inspections, consumer education, and enforcement to protect adults' freedom of choice while establishing meaningful safeguards for public health, children, consumers, and the community.
