The humiliation caused to a employee at work place which is also informally called as “bullying at work place” has serious ramifications on the mental and physical health and affects work performance.
The constitutional mandate protect the citizen's right to live with human dignity a unconditional promise that the polity owes to every citizen. But as a employee Smt.Gayatri Dhir deprived from right to dignity at workplace.
Here I am Uma shankar Dhir as a elder brother of Smt.Gayatri Dhir may allowed to tell you the true fact of ongoing workplace bullying or workplace harassment towards my sister where she is working as a Education lecturer at Silpanchal mahila mahavidyalaya,Talcher(odisha) more than 11 yeras.
Silpanchal mahila mahavidyalaya,Talcher,Dist-Angul ,Odisha is a odisha goverment aided non goverment private college and it comes under the Higher Education Department of Odisha Govt.
Smt.Gayatri Dhir working as a Education lecture from year 2007 at Silpanchal mahilaMahavidyalaya , Talcher,Dist- Angul, odisha and she was appointed by(ADM) Additional District Magistrate Angul cum secretary of Governing Body of the said college.
In year 2009 all the +2 arts teaching and non teaching staffs name were recommended including Smt.Gayatri Dhir by the college through ADM,Angul office to the Higher Education Department for get the Grant in aid by the Govt. But due to technical issue many posts could not able to get grant in aid besides 4 posts. Smt.Gayatri Dhir name in Education Post also could not able to get the Grant in aid for the technical reason in year 2009.
In year 2010 Smt.Gayatri Dhir name was recommended for the NCC officer training through ADM,Angul and after completion of officer training at Officer training academy,Gwalior she awrded as Leutenant Gayatri Dhir of 2010 batch.
In year February 2015 Smt Suniti Mishra appointed as Principal I /C as Ex-Principal tenure completed.
A Gazzate notification was published 31/12/2014 for Grant in aid of eligible post of govt aided non government private college and for the same Smt Gayatri Dhir requested several time verbally to take initiative for her post to the principal I/C(Smt.Suniti Mishra). But when she didn't shown any interest then she wrote a request letter to recommend her post to Higher education Department for the Grant in aid but in return reply Smt.Suniti Mishra handover Show cause notice for writing the same letter. After getting a show cause notice when Gayatri Dhir written her submission then Smt.Suniti Mishra again handover further Show cause notice for indiscipline action.
Have any body heard any where that for writing requesting letter to the immediate authority,the same authority handedover two show cause notices back to back?This was the first attempt of bullying to impose threat.
Then another letter Smt Suniti Mishra handedover to submit all the documents of Gayatri Dhir. In reply Gayatri Dhir submitted all the photo copies of desired documents including appointment letter. After submitting documents Smt.Suniti Mishra raised an allegation that the signature in the appointment letter doesn't reassembled with any secretary of Governing Body so this appointment letter is a forged one. This was secound attempt of bullying.
When in reply Gayatri Dhir given her submission to verify the appointment letter with office copy of the college documents and Governing body resolution. Then Smt.Suniti Mishra replied that Ex-Principal didn't handover any official documents of the college yet so Gayatri Dhir is directed to submit all the original documents for verify the same. Here Smt Gayatri Dhir replied that if there was no office records available in the college then in which capacity the principal I/C told the appointment letter is a forged one and how she made the question about the authentication of the signature of the secretary of the college Governing Body. But Smt. Suniti Mishra didn't replied any. In the time being three months already passed from when Smt. Suniti Mishra as a Principal I /C taken charge. Smt. Gayatri Dhir demanded for her legitimate salary which was pending from new Principal I/C appointed. Third attempt of bullying.
Smt.Suniti Mishra again handover a letter to submit all the original documents to release the salary. Smt. Gayatri Dhir written her submission that in year 2009 the office of the college had collected all the original documents for verification. And for grant in aid of the all eligible posts all the names of the college staff including teaching and non teaching staff name was recommended to Higher education Department through ADM angul office. And in that list the present Principal I /C, Smt.Suniti Mishra name was also recommended for the get the Grant in aid for the post of political science from Odisha Govt . The submission also given by the Gayatri Dhir was from that 2009 office of the college didn't handover her documents besides some photo copies of the documents. Then Smt.Suniti Mishra wrote another letter and asked that do the Gayatri Dhir have any receipt copy for submitting the original documents at college office?
Principal I/C, Smt. Suniti Mishra also made another allegation that though GayatriDhir have had the photo copies of the the documents so Gayatri Dhir has kept office documents in her custody and it is directed to Gayatri Dhir to handover such office documents. Forth attempt of bullying.
After getting the letter from Smt. Suniti Mishra when Gayatri Dhir asked whether any official records in register are there where Gayatri Dhir kept office documents or the office of the college handed over the college documents? Then no answer came out from the Principal I /C.
Being as Education lecture several times she requested for releasing her legitimate salary but salary not released by the principal I /C. Suddenly without any reason a letter found in staff common room addressed to Gayatri Dhir that her assigned Education class of +2 Arts stream has been withdrawn by the principal I /C still further order. In that letter by criticising Gayatri Dhir Principal I /C tried to isolate her. But Gayatri Dhir continued her struggle and with out salary and with out assigned any class she continued. This was Fifth attempt of bullying.
To release salary the principal I/C circulate a letter attached with a undertaking & declaration format. In that format referred two letter and from out of two one letter never handed over to Gayatri Dhir to know the content of that letter which referred in the undertaking format. Even after several request letter Principal I/C did not handedover that said referred letter. The principal I/C also forward a letter that the said letter which Gayatri dhir is asking for, can not be handed over as it is the College secrecy. It is in the first time in history it was happened that the letter which meant for receiver, the same receiver can not receive the referred letters where the receiver is a lecturer of same college. Neither that referred letter handed over nor her legitimate salary released by the principal I/C. This was the sixth attempt of bullying.
After several requests made by the Gayatri Dhir when the ADM angul cum special officer of the said college ask a report to the principal I/C about not release the salary of Gayatri Dhir then the principal I/C. The principal I/C replied to the ADM,Angul that though Ex-principal has not handed over any college documents so a declaration cum undertaking has circulated to all the staffs for submitting the declaration of authentication of their documents and in future if they found guilty then the amount received from the college will be recover. And the salary of Smt.Gayatri Dhir could not be released due to undertaking cum declaration not submitted by the Education Lectrer Smt.Gayatri Dhir. But fact was that in undertaking cum declaration one letter out of referred two letter did not handover to the Smt.Gayatri Dhir and without knowing the content of that referred letter it was not possible to give undertaking cum declaration by the Gayatri Dhir.
About release of salary the ADM,Angul in letter no.1072,Dated-06/08/2016 written to Gayatri Dhir that principal I/C asked for withholding your salary. The principal has reported that she has nor been handed over charges by the ex-principal Ms Sovagini Das.Tht is why. In absence of original service records and documentsshe has asked for 'Declaration and Undertaking" from the employees vide no.229,dt.26/09/2015. But except Gyatri Dhir ,all other employees has submitted the declaration in the said format and got their salary released. Hence you are directed to submit the "Declaration and Undertaking" required for official necessities to get your salary released.
On dated-22/08/2016 through ADM,Angul Undertaking cum Declaration submitted to the principal I/C as directed by the ADM ,Angul by registered post with A.D but salary not released by the Principal I/C. This was the Seventh attempt of bullying.
Gayatri Dhir continued her struggle and without salary and with out assigned any class she was continuing her duty.. From 2016 to 2017 she has given undertaking and declaration on dated-06/08/2016,dated-19/08/2016,dated-11/09/2017 but salary not released.Eighth attempt of bullying.
In 2017 Gayatri Dhir when she collected her all the original documents from Ex-Principal she intimated to the college that she has collected her original documents from ex-principal and for verification a date may be schedule as soon as possible. But the Principal remained silent.
After made complain through my twitter account @umashankardhir in November 2017 the DM angul directed through twitter handle to submit again the documents in principal office for release salary though principal replied to the DM angul that for release the salary undertaking and declaration must be needed. Again on dated13/11/2017 all the documents submitted with declaration and undertaking. Ninth attempt of bullying.
On 21st november vide letter no-243 of the principal I/C raised a allegation that two types of appointment letter photo copies found which submitted on dt-13/11/2017 & dt-18/11/2017 and the prima facie it appears that both the appintmentletters are forged/fabricated/manufactured. As such ,salary from the collegefund can not be disbursed with out verification of appointment letter. Tenth attempt of bullying and power harassment done by principal I/C.
After several request and the DM Angul ordered that Asst. collector will be available for the verification as a nominee of the DM,Angul at Schedule date. On 15th December 2017 a date fixed for verification and the principal I/C appointed a verification officer named Alok chandra Mohanty (A retired talcher municipality school headmaster) behalf of her as nominee. Gayatri Dhir had made her objection regarding a appointment of verification officer made by the principal who is a retired head master of a municipal school. Gayatri Dhir also requested to the DM angul to direct the principal to appoint a qualified designated person instead of retired headmaster of municipal high school because retired person risk is zero if he is giving any wrong finding. But the DM angul remained silence and did not take any action.
Three sittings conducted with the presence of Asst. collector and in last sitting few questions asked by Alok chandra mohanty(the nominee of principal) and told to gayatri Dhir put your final submission regarding two types of appointment letters. In her final submission Gayatri Dhir written that appointment letter number is same of two copies ,signture authority is same of two copies and date is same of two copies though these are parallel copy of one appointment letter issued by the college as same as the principal have two appointment letters and copies attached which revealed through RTI. One original appointment letter which handed over to me is having with me and the photo copy submitted earlier is the parallel appointment photo copy was with me because ex-principal given a photo copy of that parallel copy when she took all the original documents in year 2009, when after verification all the teaching and non teaching staffs name recomended to the Govt, for Grant in aid.
On 14th August 2018 Gayatri Dhir got an email from Principal I/C and it had written that "as per report submitted by the Alok chandra Mohanty you are holding an invalid appointment letter,which void ab initio. As such ,you are persona non grata in the college. Hensforth, you will not be allowed to exercise the right of a valid employee of the college including signing in the teaching staff attendance register. You are also called upon to refund all the financial benefits that you had received from the college on the basis of the said invalid appointment letter with in 30days of receipt of this letter. This was Eleventh attempt of bullying .
The report from the DM,Angul about the verification of appointment letter of Gayatri Dhir still not completed but the principal through her nominee whom she appointed as verification officer from 14th Aug to till date not allowing to enter into the college premises to Gayatri Dhir. When Gayatri Dhir meet the ADM ,Angul he told that though from our office no such order has passed that your employment is invalid you may continue your duty and if any official misconduct is happening you may give a FIR at police station and send me location to my whatsapp number from the college.
FIR given by Gayatri Dhir on dated 14th august 2018 but till today the FIR not registered by the Talcher model police station.
As per Odisha Education act principal is Ex-officio where ADM is the administrative authority in govt. aided non govt. private college. Principal has no rights to declare any employee as her employment is invalid. As per the ADM angul instruction she is going to college daily but the watchman is closing the college gate and telling her that the principal I/C instructed him not to allow Gayatri Dhir to enter into the college. Daily she is getting humiliated at college gate. Feeling insulted in front of hundreds of students where she is working more than 11yrs. As a employee she has lost her dignity and day by day due to these harassment and inaction of higher authority her mental and physical health is affecting her work performance and she is feeling injustice.
A petition perused on dated-14/10/2015 having case no.4602 by Odisha Human rights Commission to the subject of Work place harassment of Gayatri Dhir. And send the matter to the principal secretary, higher education Department and Director,Higher Education of Odisha for appropriate action but no action taken by the higher authority.
About all these incidents from day one to till date she has intimated all the higher authorities including E-abhijog portal of chief minister of Odisha but from 2016 to till date it is still showing under process where Gayatri Dhir is suffering.

There are no internal committee or any grievance redressal opportunity available for victim of work place harassment or work place bullying till now in Odisha Goverment. So I therefore request to take necessary action to eradicate such situation.
