i was forced to co-sign on an apartment for my son. Now, i'm talking a retired military officer, college graduate, and fluent in Japanese. In deciding to take a break made a life changing decision by staying 1 night in a hotel in Albuquerque NM. After this 1 night, he was forced to stay in Albuquerque and asked for assistance has he was told he HAD to rent from this property. Fast forward and 1 year later, COMPLETELY out of his character he went below down hill in less than 3 months. (Suspicious) yes, anyway he was evicted with nothing not even his car keys. Of course, never having been through this he didn't know he couldn't reenter the apartment, but did. SWAT used gas to remove hime from the apartment. AND TOOK EVERYTHING OF HIS (yes everything military id, car (yes the whole car with his belongings), computers, phone, birth certificate, passport, yes everything. then put him in jail on my birthday by the way. I was wondering why he hadn't called. Then when he's released i find out and attempt to get his car OF COURSE the police had it TOWED to a garage that will not accept payments over the phone, credit card payments, or payments from someone that is not on the registration. YES he was in jail and i couldn't reach him. OK i've set up the situation. After getting him out of Albuquerque and attempting to help him. They (De Anza) send me bills that were a mess, when i requested their lawyer schedule a phone call to go over the claimed charges. THEY FILED A LAWSUIT AGAINST US (I co signed). 1 month after the lawsuit for $28K (remember this apartment is in Albuquerque), we receive a threatening letter from the De Anza's insurance company saying they paid the bill and want to be reimbursed. However, the De Anza continued the lawsuit to collect yes $28K, apparently they didn't have to disclose to the court that they had already received their money from the insurance company. As pro se i fought them in court and we settled before trial for a whole lot less (i itemized basic cost to clean, replace what my son agreed upon, paint, etc...). They could not justify the $28K lawsuit. But the courts never dismissed my son as i suspected they would still go after him. Low and behold today, he send me the compliant from the insurance company. filed where you ask, in Albuquerque although the insurance company is located in Ohio, are you wondering why. So that Albuquerque can keep my son in the legal system. this is appalling behavior from a state, law enforcement and insurance company. WE NEED A LAW THAT PROTECTS US FROM SUCH UNETHICAL PRACTICES. I'm sure Albuquerque is not the only legal system that allows local businesses, the police, judges, lawyers, and insurance companies to SCAM, extort money, and harass. UNDERSTAND we never received an itemized bill just a letter saying they held a trial and he was found 100% at fault. Pay now and anytime De Anza submits a claim. Yes, anytime.
