The “Seymour Redevelopment Commission” seeks approval from tax-paying citizens, but they’re attempting to authorize themselves to build whatever they want, including low-income housing, without legal consequences. This will ruin the town! A declaratory resolution is a formal statement from a government body or court clarifying legal status or rights in a dispute without ordering action or providing damages. It aims to provide legal certainty and prevent future conflicts. The term can also refer to an initial action by a redevelopment commission to define or alter a development area. Key aspects include: - Clarifying legal uncertainty. - Being non-enforceable. - Being a binding legal determination. - Serving as a preventive measure. - Typically authorized by statute in common law jurisdictions. Examples include: - Determining rights and obligations in contract disputes. - Resolving rights under policies in business law. - Defining new economic development areas in redevelopment. This attempt on Monday, September 22 at 4pm, is a legal exercise to show that a formal plan includes the action defeated by the council. When it’s brought again, they’ll say, “The Jackson Park Development Plan includes this.” It’s a deceptive manipulation. Please voice your concerns and spread the word.
