Hello, I hope this message finds you well. I am a mother, in college with a 3.9 GPA in psychology. I have also been the victim of Domestic Violence. I am contacting you regarding the law “ Failure to Protect”. I would like this bill to be amended based off of new psychological evidence. I think the bill disregards victims in domestic violence and needs to be changed. I will be contacting the local news outlets to share my story. This law allows victims of domestic violence to get their children taken away. Therefore I think it should be amended. It should not allow victims of domestic violence to have their children taken away from them as long as the perpetrator is no longer living in the home. It should also be amended so that if a child witnesses domestic violence and the victim is requesting help to leave the perpetrator the child cannot be taken away. The scientific evidence from taking a child away from their parent or primary care giver is a lot more detrimental to their success, and emotional well being. Than witnessing a domestic violence situation and then being helped or guided out of this situation. New York has already amended their failure to protect law and I think it is time we do the same. I think this laws stops parents mainly victims of abuse from reaching out and leaving those situations for fear of loosing their children. The law should uphold moral standards and protect victims not punish them.
