Stop the Montrose PUD amendment and subdivision
The Issue
PETITION REGARDING PUDA-26-2 & SUBD-26-4
To the City of Post Falls Planning & Zoning Commission:
We, the undersigned residents and property owners of Post Falls and the surrounding community, respectfully submit this petition regarding the proposed amendment to the Montrose Planned Unit Development (PUDA-26-2) and the subdivision (SUBD-26-4) of approximately 76.46 acres into 346 residential lots.
We respectfully request that the City of Post Falls Planning & Zoning Commission carefully evaluate this proposal against all applicable Planned Unit Development, subdivision, zoning, comprehensive planning, transportation, infrastructure, and public-facility review criteria before making any recommendation or decision.
Our concerns include, but are not limited to, the following:
1. Traffic and Transportation
The proposed development would add a substantial number of residential lots and associated vehicle trips to the surrounding transportation network. The City's staff report identifies future improvements at the Seltice Way/Clark Fork Parkway intersection as a 2030–2035 project and identifies unresolved questions regarding the future of Mullan Avenue and its potential effect on the Seltice Way/Chase Road intersection.
We respectfully request that the Commission:
Evaluate whether existing and proposed transportation infrastructure can safely and adequately accommodate the additional traffic generated by 346 residential lots.
Evaluate whether required transportation improvements will be completed before or concurrent with occupancy of the proposed homes, rather than relying on future improvements that may not yet be funded or constructed.
Carefully evaluate the proposed extension of Clark Fork Parkway to Seltice Way and the proposed stop-controlled intersection as an interim transportation solution.
Consider the cumulative traffic impacts of this development together with other approved, pending, and anticipated development in the surrounding area.
Determine whether additional traffic-control measures, roadway improvements, intersection improvements, pedestrian improvements, or other mitigation measures are necessary before development proceeds.
Ensure that the additional transportation demands created by the proposed development do not result in existing residents bearing the cost of improvements necessary to accommodate the increased density.
2. Water and Wastewater Capacity
We respectfully request that the City fully evaluate whether existing and planned water and wastewater infrastructure has sufficient capacity to serve the proposed development in conjunction with existing and future development in the surrounding area.
The staff report indicates that existing sewer capacity is available while also noting that existing capacity does not guarantee future service.
Accordingly, we request that the Commission:
Evaluate both current and anticipated future water and wastewater capacity.
Consider the cumulative demand created by this development and surrounding development.
Require confirmation that adequate infrastructure will be available when the proposed lots are developed and occupied.
Identify any necessary utility improvements, extensions, upgrades, or mitigation measures.
Ensure that existing residents and property owners are not negatively affected by inadequate infrastructure or required to absorb costs attributable to the additional demand created by this development.
3. Neighborhood Compatibility, Density, and Site Design
The proposal would create 346 residential lots on approximately 76.46 acres in an area surrounded by existing residential neighborhoods, an elementary school, and commercial uses.
We respectfully request that the Commission carefully evaluate:
The overall density of the proposed development.
Proposed lot sizes and configurations.
The layout and design of the subdivision.
Setbacks and transitions between the proposed development and existing neighborhoods.
Buffering, landscaping, fencing, and other screening measures.
Potential impacts on privacy, noise, traffic, pedestrian movement, and the overall character of surrounding neighborhoods.
Whether the proposed density and site design are compatible with the existing and planned development pattern of the area.
Whether additional buffering or other conditions are necessary to protect adjacent properties and maintain appropriate transitions between uses.
4. Public Facilities and Community Impacts
The Commission should fully evaluate the anticipated impact of the proposed development on existing and planned public facilities and services, including:
Streets and intersections;
Sidewalks and pedestrian infrastructure;
Parks and recreational facilities;
Emergency response and public safety services;
Schools and related traffic impacts;
Water and wastewater systems;
Stormwater infrastructure;
Other municipal infrastructure and public services.
We respectfully request that the City identify the specific mitigation measures necessary to address these impacts and determine who will be responsible for the associated costs.
The developer should be required to provide its fair and proportionate share of improvements and mitigation necessitated by the additional demand created by the proposed development, as applicable.
Existing residents and property owners should not be expected to absorb increased costs, infrastructure deficiencies, or deferred improvements that are caused or exacerbated by the additional density and population resulting from this proposal.
5. Comprehensive Planning and Land-Use Consistency
We respectfully request that the Planning & Zoning Commission determine whether the proposed amendment and subdivision are consistent with the City's adopted comprehensive plan, applicable land-use policies, zoning requirements, Planned Unit Development requirements, subdivision standards, and other applicable regulations and approval criteria.
This evaluation should include consideration of:
Whether the proposed density is appropriate for the area;
Whether the proposed development is consistent with the City's planned growth patterns;
Whether adequate transportation and public infrastructure can support the proposed density;
Whether the proposal is compatible with surrounding land uses;
Whether required public facilities and services are available or can be adequately provided;
Whether appropriate mitigation and development conditions are necessary to address identified impacts.
6. Required Mitigation and Fair Allocation of Costs
We respectfully request that the City not approve the proposed amendment and subdivision without first identifying and addressing the impacts associated with the additional density and population.
If the project is ultimately approved, we request that the approval include specific, enforceable conditions of approval requiring appropriate mitigation for identified impacts.
Such conditions should, as applicable, address:
Transportation and intersection improvements;
Pedestrian and bicycle infrastructure;
Water and wastewater infrastructure;
Stormwater management;
Parks and recreational impacts;
Emergency services and public safety;
School-related impacts;
Neighborhood buffering and compatibility;
Other infrastructure or public-service impacts identified through the City's review.
The costs of improvements or mitigation reasonably attributable to the proposed development should be fairly allocated to the development rather than shifted to existing Post Falls residents and property owners.
7. Public Record and Consideration of Community Concerns
We understand that the Planning & Zoning Commission must evaluate the application based upon the City's adopted review criteria, applicable regulations, and the evidence presented during the public hearing process.
We therefore respectfully request that:
This petition and the signatures below be entered into the official public record for PUDA-26-2 and SUBD-26-4.
The concerns identified in this petition be considered as part of the Commission's review.
The Commission evaluate the proposal against all applicable approval criteria and development standards.
Any identified deficiencies or impacts be addressed before approval is recommended or granted.
Any required mitigation measures be clearly identified and incorporated into enforceable conditions of approval.
REQUEST OF THE UNDERSIGNED
For the reasons stated above, we respectfully request that the Post Falls Planning & Zoning Commission carefully evaluate PUDA-26-2 and SUBD-26-4 based upon all applicable criteria and the evidence presented during the public review process.
We further request that the Commission require appropriate mitigation for impacts associated with the proposed development and ensure that the costs of necessary improvements are fairly allocated to the development responsible for creating the additional demand.
We respectfully ask that the City protect the interests of existing residents and property owners while ensuring that future development is appropriately planned, adequately supported by infrastructure, compatible with surrounding neighborhoods, and consistent with the City's adopted plans, regulations, and development standards.
