Zaustavimo nezakonito uznemiravanje i protjerivanje zaštićenih ptica u Puli!

Ministarstvu zaštite okoliša i zelene tranzicije
Zašto pokrećemo ovu peticiju?
Nedavno je u medijima odjeknula vijest da su na krov zgrade FINA-e na Giardinima u Puli smještena četiri sokola s ciljem "prirodne regulacije" i odvraćanja drugih ptica (poput galebova i čvoraka) iz užeg centra grada. Iako se to predstavlja kao "prirodna metoda", ovakav čin izravno narušava dobrobit ptica koje su zakonom zaštićene te predstavlja potencijalno kršenje propisa o zaštiti prirode Republike Hrvatske.
Galebovi (posebice galeb klaukavac – Larus michahellis) i čvorci (Sturnus vulgaris) zakonom su zaštićene vrste u Republici Hrvatskoj. Namjerno uvođenje predatora radi njihova sustavnog uznemiravanja, zastrašivanja i tjeranja iz njihovih uobičajenih staništa u urbanim zonama suprotno je načelima očuvanja bioraznolikosti.
Smatramo da je ovakva praksa u suprotnosti sa sljedećim zakonskim aktima Republike Hrvatske:
Zakon o zaštiti prirode (NN 80/13, 15/18, 14/19, 127/19, 155/23):
Sukladno ovome Zakonu i pratećem Pravilniku o strogo zaštićenim vrstama, divlje ptice koje prirodno obitavaju na području RH uživaju posebnu zaštitu. Članak 153. Zakona o zaštiti prirode izričito zabranjuje:
Namjerno uznemiravanje divljih životinja, posebno u vrijeme razmnožavanja, podizanja mladih, hibernacije i migracije.
Oštećivanje ili uništavanje područja njihova razmnožavanja, hranjenja ili odmaranja.
Korištenje treniranih sokolova u gusto naseljenoj gradskoj jezgri ne predstavlja "prirodnu migraciju", već namjerno i umjetno uznemiravanje ptica na lokacijama gdje se hrane i gnijezde.
Osim čvoraka i galebova, u krošnjama ladonja Giardina borave i golubovi te grivnjaši.
Mi, dolje potpisani i svi građani koji su potpisali ovu peticiju, zahtijevamo od nadležnih institucija:
Hitno obustavljanje projekta korištenja ptica grabljivica (sokolova) za protjerivanje galebova, čvoraka i drugih ptica s područja Giardina i uže jezgre Pule.
Inspekcijski nadzor: Tražimo od Inspekcije zaštite prirode Državnog inspektorata da utvrdi je li za ovu aktivnost ishođeno odgovarajuće dopuštenje Ministarstva te jesu li prekršene odredbe Zakona o zaštiti prirode.
Kao alternativu sugeriramo humana i znanstvena rješenja. Zahtijevamo da eventualnu prenapučenost pojedinih vrsta rješava isključivo ekološki prihvatljivim i humanim metodama (poput kontrole izvora hrane, pravilnog zbrinjavanja otpada te kontrole plodnosti zamjenskim jajima – što se već uspješno provodi u nekim istarskim gradovima), a ne metodama zastrašivanja i progona.
Urbana bioraznolikost je dio našeg suživota s prirodom. Zaštitimo galebove i čvorke, te ostale ptice centra grada, od agresivnih metoda kontrole i osigurajmo poštivanje zakona RH!

Why are we launching this petition?
Recently, a news broke in the media stating that four falcons have been stationed on the roof of the FINA building at Giardini in Pula. The goal is a "natural regulation" and deterring other birds (such as seagulls and starlings) from the city center. Although presented as a "natural method," this act directly harms the well-being of legally protected birds and constitutes a potential violation of the nature protection regulations of the Republic of Croatia.
Seagulls (specifically the yellow-legged gull – Larus michahellis) and starlings (Sturnus vulgaris) are legally protected species in the Republic of Croatia. Deliberately introducing predators for the purpose of systematically harassing, scaring, and driving them away from their usual habitats in urban areas contradicts the principles of biodiversity conservation.
We believe this practice violates the following legal acts of the Republic of Croatia:
Nature Protection Act (Official Gazette/NN 80/13, 15/18, 14/19, 127/19, 155/23):
Pursuant to this Act and the accompanying Ordinance on Strictly Protected Species, wild birds naturally occurring in the territory of the Republic of Croatia enjoy special protection. Article 153 of the Nature Protection Act explicitly prohibits:
- Deliberate disturbance of wild animals, especially during breeding, rearing, hibernation, and migration periods.
- Damaging or destroying their breeding, feeding, or resting sites.
Using trained falcons in a populated city center does not represent "natural migration" but rather a deliberate and artificially induced disturbance of birds at locations where they live, feed and nest.
Note: In addition to starlings and seagulls, the canopies of the nettle trees (ladonja) on Giardini also host pigeons and common wood pigeons.
We, the undersigned, and all citizens supporting this petition, demand from the competent institutions:
The immediate suspension of the project using birds of prey (falcons) to expel seagulls, starlings, and other birds from the Giardini area and Pula's city center.
An official inspection: We request that the Nature Protection Inspection of the State Inspectorate determine whether appropriate authorization was obtained from the Ministry for this activity, and whether the provisions of the Nature Protection Act have been violated.
We demand that na eventual overpopulation issue of certain species be resolved exclusively through environmentally friendly and humane methods (such as controlling food sources, proper waste management, and fertility control using dummy eggs—which is already being successfully implemented in other Istrian towns), rather than methods of intimidation and expulsion.
Urban biodiversity is part of our coexistence with nature. Let's protect the seagulls, starlings, and other birds of the city center from aggressive control methods and ensure that the laws of the Republic of Croatia are respected!
