Hi All, 

Thanks for everyone's support in stopping the addition of the School District Maintenance yard at Kettler. The above photo shows my quick Photoshop of the dark corridor that the HBCSD is proposing in the public park walkway from Breton Lane.  How is that safe at night?

I have been busy with life and not with local zoning issues; my bad for the late notice here.  For those that did not know, the HB Planning department was on the verge of denying the district's plans at the July 24 meeting, but they put an in pause on the  conditional use permit pending more information.  The first condition is to conduct a sound study to determine environmental impact, and second, to provide proof that the soil moved from Petersen Elementary and graded at the Kettler site was tested as safe.  The school district stated to the Planning Commission that they have conducted soil testing and will provide the Planning Commission with the results.

There is a school board meeting at 6 p.m. tonight. I will summarize the findings of the HB Planning Commission for the board.   Later in the night's agenda, I saw that the district recommended extending the lease to the existing bus yard on Gothard. See attached. 

Today, I filed a zoning code enforcement request with the city for the existing and unhoused maintenance yard. We'll see what happens with that.  

Please read this when you get a chance. I've always held that the district must comply with local zoning laws when proposing projects for non-classroom facilities. This article summarizes the history of Title 5 and specifically State Code 53094. Surprisingly, in 1984, they also added Code 53097, dealing with drainage plans and grading. Who knew?

HBCSD continues to claim they can go to the DSA for the maintenance yard approval, but can they? It seems clear to me that they still need to get city approval. I don't know how they could reasonably argue that they could override the city zoning laws and do as they wish. I say, good luck with that.  

I'm trying to meet with the HBCSD assistant Superintendent, Jenny Delgado, to have a community status meeting on this topic.  

So, we have an unhoused maintenance yard with no conditional use permit.  I called and left a message with Jenny Delgado, district assistant manager, letting her know that I filed a zoning violation.  I want to ensure the new lease they sign on Gothard includes housing for the unhoused maintenance yard in their lease.  I believe they have been storing supplies at Gothard they thought would be in the new M&O building.  Additional updates to follow soon.
