STOP THE FLAVOR BAN - STOP BILL 229-37

The Issue

In February 2023, Senator Thomas Fisher introduced Bill 50-37, a bill aiming to completely ban all flavored vapes, or Electronic Nicotine Delivery Systems (ENDS) on Guam, to end the “epidemic” of youth vaping. Let it be clear: ADULT (21+) products should not be in the hands of CHILDREN. 

ENDS are designed to deliver nicotine in a much less harmful manner than cigarettes. With the intention to “protect the youth,” legislators resort to banning flavored ENDS. However, they fail to consider responsible adult ENDS users who will be unfairly punished for the illegal activity of youth.

On January 5, 2024, Senator Fisher refiled the bill as Bill 229-37 (COR) – an update to Bill 50-37– which would affect more than just the adult vape users it originally targeted.

Did you know that in Bill 229-37: 

  • Flavor includes but is not limited to fruit, chocolate, candy, mint, and menthol?
  • Flavored CIGARETTES, cigars, pipe tobacco, CHEWING TOBACCO, snuff, snus, and CANNABIS would be banned too?
  • E-cigars, e-pipes, e-hookahs, and VAPE PENS would be targeted too?
  • Retailers communicating in any way, such as through labeling, packaging, and advertising, that tobacco products are “cool,” “chill,” or “fresh” are violating the law?
  • You would be unable to purchase these products at any retail location, which includes any gas station, convenience store, and mom n’ pop store?

As you can imagine, Bill 229-37 would put the local vape industry out of business, hundreds of jobs would be lost, and of course, the everyday, hardworking, taxpayer will no longer have the FREEDOM to use any of these products. Again, these include flavored ENDS, CIGARETTES, cigars, pipe tobacco, CHEWING TOBACCO, snuff, snus, and some CANNABIS products. And for many ENDS users, they vape to quit cigarettes and taking this choice away sets them at more risk for the dangers of smoking. Moreover, if we allow this bill to be enacted as law, the future of other flavored adult products, such as alcohol, will also be in jeopardy. Prohibition creates crime.

Bill 229-37 punishes the working people, and it aims to erase all stand-alone tobacco stores. It fails to address how the government will fund enforcement, forcing the taxpayer to foot the bill.
