Thank you for reaching out to Rep. August’s office. Rep. August has asked me to compile some information regarding the proposed Foundry Ridge Energy Center for you.

On March 17, Invenergy submitted a pre-application engineering plan for the Foundry Ridge Energy Center. That engineering plan was revised and refiled to the Public Service Commission’s (PSC) electronic records filing system on June 3rd under docket 9835-CE-100. To view the filing, please visit the following link.

Because the proposed natural gas facility is expected to have a capacity of over 300 megawatts (MW) of generation capacity, the applicant is required to receive a certificate of public convenience and necessity (CPCN) from the PSC prior to construction. The engineering plan notes that the CPCN application filing is anticipated to occur in the second quarter of 2025. We have reached out to Invenergy for an update on their anticipated filing timeline and can provide that information when it becomes available.

Once filed, when reviewing a CPCN application, the PSC has 30 days to determine whether the application is complete. The PSC then has 180 days in which to take final action on the application, unless the chairperson of the Commission extends the time period for an additional 180 days for good cause (Wis. Stat. § 196.491(3) setting timelines). Because the application has not yet been filed, it will be several months before the Commission makes a decision on the proposed project.

It is Rep. August’s opinion that this natural gas plant should not need to be in Darien. However, there is no legislative power he wields over this decision. Rep. August does plan to contact the PSC and voice his and his constituents’ displeasure. The PSC does have sole and final say in these matters, but Rep. August will be sure that it is understood he believes the people of Darien do not need this plant in this location.
