Supporters, we’ve entered August with more urgency than ever. Our opposition to the App Store Accountability Act continues to gather momentum, especially as legal experts increasingly argue that the law fails *strict scrutiny*—the highest standard of judicial review under U.S. constitutional law.
🚨 **Fails Strict Scrutiny Test**
Laws burdening fundamental rights—like a teen’s access to digital expression, privacy, and educational tools—must prove they serve a *compelling governmental interest* and are *narrowly tailored* to achieve that interest. This Act does neither.
- It applies overly broad age restrictions, even to platforms with strong existing safeguards.
- It undermines teens’ ability to use mental health apps, social support groups, and artistic outlets—without offering clear justification or less restrictive alternatives.
📜 **COPPA Conflict Remains**
Congress already defined digital consent parameters under COPPA. This Act attempts to override those rules by requiring parental consent for 16-year-olds—creating confusion and direct legal conflict. Under the **Supremacy Clause**, that’s unconstitutional.
⚖️ **Due Process, Equal Protection & Overreach**
- Strips teens of account autonomy without clear appeals or protections.
- Singles out youth aged 13–17 despite existing rights in employment, education, and health decisions.
- Extends federal control across app platforms in ways some scholars say violate the **Commerce Clause**.
🧒 **My Story as a 16-Year-Old**
I deserve the same rights I’ve had for years. This bill would erase access to the tools I rely on—browser apps, gaming apps, etc. Letting that happen without a fair legal review is unacceptable.
📬 **What You Can Do This Month**
- **Email your lawmakers**, especially those in Commerce and Judiciary Committees—volume is power.
- **Share your experience**: Show how this affects your school, mental health, or safety.
- **Demand a delay to March 13, 2027** so Congress can rework this broken bill and uphold constitutional standards.
Our petition now has thousands of voices. Let’s keep amplifying them until Washington listens. You can read, sign, and share the campaign [right here](https://www.change.org/p/stop-the-app-store-accountability-act-delay-it-until-march-13-2027
